The Conflict and Court Order The organization’s appeal comes in response to a recent Federal High Court ruling in Abuja that remanded Sowore to the Kuje Correctional Centre. This decision was handed down after the court rejected Sowore’s request for the presiding judge to recuse himself due to perceived bias. SERAP maintains that Sowore’s detention is an unjust reaction to his peaceful exercise of rights, including freedom of expression, association, and assembly.

Concerns Over Democratic Freedoms In a statement from Deputy Director Kolawole Oluwadare, SERAP condemned the government’s growing tendency to use criminal defamation and cybercrime laws as tools to intimidate journalists, bloggers, and rights defenders. The group emphasized that:

  • Public figures must accept higher levels of public scrutiny than private individuals.

Calls for Structural Reform Beyond Sowore’s immediate case, SERAP issued a broader call for the Tinubu administration to protect media freedom and human rights by ending what it terms “authoritarian practices”. Specifically, the group is calling for:

  • Direct Presidential Action: President Bola Tinubu should instruct the Department of State Services (DSS) to respect the rights of activists and media practitioners.

  • Legislative Review: The government must reform the Official Secrets Act, the Criminal Code Act, and the Cybercrime Act.

  • Alignment with Global Standards: These laws require amendment to ensure they no longer restrict free speech or impede the enjoyment of fundamental rights.
