“Jonathan Gains Ground” – Lawsuit Against His 2027 Presidential Bid Suffers Major Hitch.

Reports indicate that the case was unable to proceed on Friday due to the absence of the Independent National Electoral Commission (INEC), which also failed to appear during the previous sitting on May 11 when the matter was first scheduled for hearing.
During Friday’s proceedings, the Attorney General of the Federation (AGF) and Minister of Justice, who is listed as the third defendant in the suit, informed the court that he had not been served with the originating summons by the plaintiff.
According to the AGF, the failure to receive the court documents prevented him from entering an appearance or filing the necessary legal processes.
Following INEC’s absence and the AGF’s complaint over improper service, Justice Lifu adjourned the matter to allow all parties to be properly notified. He directed the plaintiff to regularize the filing process and ensure that all defendants receive the relevant court documents and hearing notices before the next hearing date.
The suit had earlier suffered delays on May 11 after the plaintiff, lawyer Johnmary Jideobi, and his counsel failed to appear in court without explanation. On that same date, both INEC and the AGF were also absent.
Counsel to former President Jonathan, Chris Uche (SAN), had previously urged the court to dismiss the suit for lack of diligent prosecution and requested a ₦5 million cost award against the plaintiff.
The plaintiff is seeking an order barring Jonathan from presenting himself to any political party as a presidential aspirant for the 2027 election. He also wants the court to restrain INEC from accepting, processing, or publishing Jonathan’s name as a candidate.
At the heart of the suit is a constitutional question over whether Jonathan remains eligible to contest again under the 1999 Constitution.
The plaintiff argued that Jonathan had already exhausted the constitutional limit by completing the tenure of late President Umaru Musa Yar’Adua after his death in 2010 and subsequently serving a full four-year term following the 2011 election.
According to an affidavit filed in support of the case, Jonathan assumed office on May 6, 2010, after Yar’Adua’s death on May 5, 2010.
The plaintiff maintained that growing speculation linking Jonathan to the 2027 race prompted the legal action, arguing that if Jonathan contests and wins, he would effectively be taking the presidential oath for a third time.
He insisted that the suit was filed in the public interest to safeguard constitutional order and protect Nigeria’s democratic framework.
