Again, Industrial Court Affirms Bola-Audu ASCSN President, Fines Factional Leaders N70m.

The National Industrial Court (NIC) in Abuja has once again affirmed Comrade Innocent Bola-Audu as the duly elected President of the Association of Senior Civil Servants of Nigeria (ASCSN), bringing an end to a legal dispute over the union’s leadership that has lasted more than four years.....KINDLY READ THE FULL STORY HERE▶

The court on Wednesday ordered that Bola-Audu should be allowed to assume full control of the union, including its national secretariat, without obstruction, harassment, or interference from the defendants.

Delivering judgment in the second phase of the case (Suit No. NICK/ABM/169/2025), Justice Rakiya Bosede Haastrup ruled that Sheu Mohammed and Apebo Joshua, who had been presenting themselves as national president and secretary general of the association, lacked any legal backing for their claims.

The court upheld the August 10, 2024 election that returned Bola-Audu for a second four-year term, stating that it was properly conducted in line with the ASCSN constitution. It also invalidated a rival election held in Lagos, which produced Mohammed and Joshua as factional leaders, describing it as unconstitutional and illegitimate.

In addition, the court directed the Accountant General of the Federation, also a respondent in the case, to release check-off dues belonging to union members to the Bola-Audu-led executive.

Justice Haastrup noted that a previous judgment delivered on July 9, 2024, which had already affirmed Bola-Audu’s leadership, remained valid and binding, as the opposing faction did not file an appeal. The court also reaffirmed that Bola-Audu’s earlier suspension and expulsion by the union’s internal bodies had already been declared unlawful.

The judge further dismissed allegations previously made against him, noting that such claims had already been struck out by a competent court.

The court criticised Mohammed and Joshua for continuing to act contrary to subsisting judgments, stressing that court orders are to be obeyed and not disregarded.

As part of the ruling, the court imposed a ₦10 million fine on each of the two defendants for contempt and vindictive conduct, as well as ₦50 million in exemplary and aggravated damages to be paid to the claimants.

It also nullified all letters and communications issued by the defendants to government bodies and individuals challenging the recognised leadership of the union, and issued a restraining order preventing them or their agents from interfering with the union’s activities or properties.

The court further extended the tenure of the Bola-Audu leadership by six months to cover the period they were denied access to the national secretariat.

Reacting after the judgment, Bola-Audu expressed appreciation to the judiciary and called for reconciliation, urging all parties to work together in the interest of the association’s over 600,000 members.

President Bola Tinubu is expected to visit Ibadan, the Oyo State capital, on November 21 for the APC rally scheduled to hold at Mapo Hall.

The planned event comes as political activities intensify ahead of the 2027 general elections, with the proposed venue attracting public attention.

Addressing the issue, Makinde maintained that public facilities belong to the people of Oyo State and should be managed transparently and fairly, without political bias.

According to him, “public assets belong to the people of Oyo State and must be administered in a manner that is transparent, equitable, and devoid of partisan considerations.”

The governor stressed that his administration remains committed to ensuring a level playing field for all political stakeholders, irrespective of their party affiliations. He added that democracy thrives when political parties have equal opportunities to engage with voters within the confines of the law.

Makinde further explained that access to government-owned facilities is subject to established procedures and regulations designed to ensure proper use, maintenance and public order.

He stated that any political party or organisation that meets the stipulated requirements should not be subjected to discrimination or unfair restrictions when seeking to use such facilities.

The governor also urged political actors to conduct their activities peacefully and responsibly. He called on relevant authorities to handle requests for public facilities professionally, fairly and without prejudice.

The statement reaffirmed the Oyo State Government’s commitment to promoting political tolerance, safeguarding democratic freedoms and creating an environment where legitimate political activities can take place in accordance with the law.
