Supreme Court Rejects David Mark’s Application For Stay Of Execution On ADC Leadership.

The ruling on Tuesday followed the withdrawal of the application by Mark’s counsel, Jibril Okutepa (SAN).
Okutepa informed a five-member panel of the apex court, led by Justice Lawal Garba, that INEC’s interpretation of the March 12 Court of Appeal decision had effectively created a leadership vacuum within the party.
He argued that the “status quo ante bellum” order of the appellate court had contributed to the current uncertainty over the party’s leadership structure.
The senior lawyer urged the court to treat the matter urgently, citing time constraints ahead of the 2027 general elections.
However, the Supreme Court granted procedural directions aimed at expediting the hearing process, including abridged timelines for filing legal briefs and responses, in view of the urgency of the case.
The court subsequently fixed April 22, 2026, for the substantive hearing of the appeal.
Mark had approached the Supreme Court following INEC’s decision to derecognise his leadership of the ADC, based on a Court of Appeal ruling arising from a suit filed by Nafiu Bala Gombe, a former Deputy National Chairman.
Gombe is challenging the party’s leadership structure and seeking to stop Mark, Rauf Aregbesola, and others from parading themselves as national officers of the ADC, as well as preventing INEC from recognising them.
Following the appellate court’s directive on maintaining the status quo, INEC removed the names of Mark and Aregbesola from its official portal as National Chairman and National Secretary of the ADC.
