Court Sets April 14 To Hear Suit Challenging David Mark’s ADC Leadership.

A Federal High Court in Abuja has scheduled April 14 to hear a suit filed by Nafiu Bala, a former Deputy National Chairman of the African Democratic Congress (ADC), challenging the leadership of ex-Senate President David Mark.....KINDLY READ THE FULL STORY HERE▶

Bala is asking the court to restrain the Mark-led faction from presenting themselves as the party’s national leadership.

The suit, marked FHC/ABJ/CS/1819/2025, lists the ADC, Mark, Rauf Aregbesola, the Independent National Electoral Commission (INEC), and Ralph Nwosu as defendants.

He argued that he never stepped down from his role as National Vice-Chairman and should have automatically assumed leadership after Nwosu’s exit. Based on this claim, Bala declared himself the party’s National Chairman, insisting the ADC constitution backs his position.

In the suit filed on September 2, 2025, he urged the court to stop INEC from recognising the Mark-led executives and instead acknowledge him as acting national chairman. He also sought orders to halt party meetings, congresses, and conventions pending the outcome of the case.

When the ex parte motion came up on September 4, 2025, Justice Emeka Nwite directed the defendants, including INEC, to appear and justify why the application should not be granted.

However, Mark later challenged the court’s jurisdiction at the Court of Appeal, but on March 12, 2026, the appellate court dismissed his appeal, describing it as lacking merit, and instructed all parties to return to the trial court while maintaining the existing situation until the case is resolved.

Following that ruling, INEC announced on April 1 that it would no longer recognise either the Mark or Bala factions, stating it would not engage with or monitor activities of both groups.

Reacting, the Mark-led faction filed a motion on April 7 seeking an order to compel INEC to restore their recognition and requested an accelerated hearing.

Mark also filed a preliminary objection, arguing that Bala lacks the legal standing to institute the case, claiming he had earlier resigned and that the matter concerns internal party affairs beyond the court’s jurisdiction.

Similarly, Aregbesola asked the court to dismiss the suit, insisting Bala is no longer part of the party’s National Executive Committee and had voluntarily resigned during a restructuring process. He also requested ₦50 million in damages.

In the same vein, Nwosu challenged the suit, describing it as premature and arguing that Bala failed to exhaust the party’s internal dispute resolution mechanisms before heading to court.
