“Kanu’s Terrorism Appeal Begins – Lawyer Reveals Next Moves”.

In a statement on Wednesday, Ejimakor said the notice of appeal filed in February 2026 triggered the appellate process. He urged supporters and the public to focus on the formal legal procedures rather than rumours or speculation.
“The appeal will follow clearly defined stages until it is fully heard and determined by the Court of Appeal,” he said. “People should concentrate on these sequential stages instead of expecting the process to mirror the High Court proceedings before Justice Omotosho.”
He outlined that the first stage involves compiling and transmitting the Record of Appeal by the registrar of the Federal High Court in Abuja. This record includes the charge sheet, court proceedings, exhibits, rulings, judgment, and sentence from the trial court. Ejimakor confirmed this stage has already been completed.
“For terrorism cases, Practice Directions fast-track this process. The registrar has a short window to finalise and transmit the record to the Court of Appeal registry, which has been done,” he added.
The next stage entails filing briefs of argument. Kanu’s legal team is expected to submit its Appellant’s Brief within 45 days of receiving the record, detailing 22 grounds of appeal and why the conviction should be overturned. The Federal Government, as respondent, will then file its Respondent’s Brief within 30 days, with Kanu’s team potentially submitting a Reply Brief within 14 days if new issues arise. These briefs form the main basis for the appellate court’s deliberations.
Once the briefs are filed, the Court of Appeal will set a hearing date. At the hearing, lawyers for both sides will present oral arguments before a three-member panel of justices, who may ask questions and review the written submissions. Ejimakor stressed that no new evidence or oral testimony, as in the High Court, will be permitted.
After hearing the arguments, the appellate court will reserve a date for judgment, which must be delivered within 90 days. The court may either:
- Allow the appeal, quashing the conviction and sentence, and discharge Kanu
- Dismiss the appeal, upholding the conviction and sentence
- Order a retrial, returning Kanu to an unconvicted status and reopening the case
The Court of Appeal’s judgment will be final unless either party proceeds to the Supreme Court.
Ejimakor emphasized that the appeal is already active: “The filing of the notice in February 2026 started the clock. The next visible milestone, the transmission of the Record of Appeal, has been completed, and the exchange of briefs is in progress.”
He added that terrorism-related appeals are typically prioritised and may move faster under the existing Practice Directions.
