Court Sets June 17 To Hear El-Rufai’s ₦1 Billion Case Against ICPC.

The Federal High Court in Abuja has scheduled June 17 to hear a ₦1 billion fundamental rights suit filed by former Kaduna State Governor Nasir El-Rufai against the Independent Corrupt Practices and Other Related Offences Commission (ICPC) over a controversial raid on his Abuja residence.....KINDLY READ THE FULL STORY HERE▶

El-Rufai, who governed Kaduna State from 2015 to 2023 and previously served as FCT Minister under former President Olusegun Obasanjo, challenged the legality of the search warrant used by the anti-graft agency. The suit, filed as FHC/ABJ/CS/345/2026, seeks a declaration that the February 4 warrant issued by a Chief Magistrate of the FCT Magistrate’s Court was invalid.

According to El-Rufai, the warrant authorizing the search and seizure of items from his home was “invalid, null, and void,” citing drafting errors, vague execution terms, overbreadth, and lack of probable cause, which he says rendered the operation unconstitutional. He argued that the raid violated his constitutional rights to dignity, personal liberty, fair hearing, and privacy under Sections 34–37 of the Nigerian Constitution.

During Tuesday’s proceedings, Justice Joyce Abdulmalik approved an application to remove the Chief Magistrate initially named as the second defendant, after counsel Ugochukwu Nnakwu explained that the specific judicial officer was not properly identified in the suit. The judge struck out the magistrate’s name, a move opposed by ICPC’s lawyer Abdul Mohammed (SAN), who argued it undermined the case. The judge, however, allowed the anti-graft agency to file a counter-affidavit.

El-Rufai is seeking ₦1 billion in general, exemplary, and aggravated damages for the alleged unlawful search and seizure, as well as a declaration that any evidence obtained during the raid be deemed inadmissible. He also requested an order compelling ICPC and the Inspector-General of Police to return all items seized, which reportedly include 14 electronic devices such as mobile phones, flash drives, and a laptop.

The court adjourned the matter to June 17 for hearing.
