Court Backs Siminalayi Fubara In Legal Battle Against APC Chairman.

A Federal High Court in Abuja has approved substituted service of court documents on the National Chairman of the All Progressives Congress (APC), Nentawe Yilwatda, and other party officials in a case challenging an alleged exclusion from the party’s national convention election.....KINDLY READ THE FULL STORY HERE▶

The order was granted on Monday by Justice Joyce Abdulmalik after an ex-parte application by the plaintiff’s lawyer, Ogochukwu Onyema.

The court also postponed the hearing of all pending applications in the matter, including a preliminary objection filed by the APC, until April 24.

The suit was filed by Fubara Dagogo, who contested for the position of APC National Vice Chairman (South South).

Dagogo is seeking to invalidate any outcome of the party’s national congress that barred him from participating in the election.

He claimed that despite being cleared and paying for both the expression of interest and nomination forms, he was denied the opportunity to contest.

In the case, Dagogo listed the APC and its national chairman, Yilwatda, as defendants, alongside Victor Giadom, APC National Vice Chairman (South South), and Sulaiman Muitamma, APC National Organising Secretary.

The plaintiff further urged the court to declare that, based on APC’s Payment Acknowledgment Receipt No. 26827 dated March 13, he is entitled to the party’s expression of interest and nomination forms for the position.

He also demanded N100 million in general damages against Giadom and Muitamma, alleging that their actions caused him emotional distress and embarrassment.

Meanwhile, the APC, through its counsel Kayode Okunade, filed a preliminary objection, asking the court to dismiss the case on the grounds of lack of jurisdiction.

The party argued that issues relating to internal party affairs, such as congresses and pre-primary processes, fall strictly within its domain.

Okunade further maintained that the suit was premature, noting that Dagogo failed to exhaust the party’s internal dispute resolution channels.

He also argued that the plaintiff lacks the legal standing to file the case and described the suit as an abuse of court process.

During Monday’s proceedings, Onyema told the court that the defendants had not been successfully served with the court documents, prompting the request for substituted service, which the judge granted.

Justice Abdulmalik directed that all court processes, including the originating summons, be served on Yilwatda, Giadom, and Muitamma.

The court also ordered that hearing notices for the next sitting be delivered to all parties to ensure their attendance.

The case has been adjourned to April 24 for further hearing.
