The case, filed as FHC/B/CS/20/2026, seeks ₦500 million in general and exemplary damages against 11 individuals, the Department of State Services (DSS), and the Attorney-General of the Federation (AGF).

Court documents, prepared by the law firm of human rights lawyer Femi Falana (SAN), state that the incident occurred on December 28, 2025. Obaseki alleges he was violently abducted by armed men while engaged in recreational activities in Benin City.

He claims that the 1st to 11th respondents, including Osazee “Kabaka” Adun and Osamede “Nomoless” Eriyo, physically assaulted him, stripped him naked in public, and paraded him through major streets while recording the incident. Videos of the event were reportedly circulated widely, causing severe psychological trauma and reputational damage.

Obaseki further stated that he was detained at a police station for approximately five hours without lawful justification, asserting that the actions violated his constitutional rights to dignity and personal liberty.

He also accused the DSS and AGF of failing in their statutory duties by allegedly refusing to arrest or prosecute the suspects despite apparent video evidence.

The suit, signed by Femi Falana (SAN), Funmi Falana (SAN), and Taiwo E. Olawanle, lists respondents including Osazee Kabaka Adun (alias Kapuepue), Osayande Obakhavbaye, Gege Izua Adun, Osamede Nomoless Eriyo, Julius Imafu, Uyigue Obazehowan, Osamiemwanfan Ojo (alias Sales Guy), Rambo Izua Adun, Uwaifo Orhue Ogiugo, Osaro Iyamu (alias Culture), Chris Osa Media, alongside the DSS and AGF.

Obaseki is seeking court declarations that his fundamental rights to life, dignity, personal liberty, and privacy, as protected under Sections 33, 34, 35, and 37 of the 1999 Constitution, were violated. He is also requesting that the DSS and AGF be compelled to investigate and prosecute the alleged perpetrators.

Additional reliefs include an order requiring respondents to publish a formal apology in two national newspapers and the payment of ₦500 million for physical and emotional distress.

Falana & Falana Chambers, through Secretary Tayo Soyemi, emphasized that the case extends beyond personal redress. “Our client has chosen the path of law, constitutional process, and institutional accountability,” the statement said.

The firm added, “This case aims not only at personal redress but at affirming that no citizen should be subjected to unlawful violence or public degradation under a constitutional democracy.”

A separate criminal process has also been initiated in connection with the incident, and the Federal High Court has yet to set a hearing date.

During a recent visit to Washington, D.C., Peter Obi, the presidential candidate of the Nigeria Democratic Congress (NDC), argued that the prevalence of election rigging in Nigeria is largely due to voters failing to actively defend their ballots. Obi emphasized that while candidates play a role in the process, credible outcomes ultimately depend on citizens remaining at their polling units to ensure votes are counted transparently. He criticized the “transactional” nature of Nigerian politics, suggesting that many voters prioritize other activities over the essential task of monitoring the electoral process. According to Obi, Nigeria’s primary challenge is poor political leadership, and he urged citizens to take collective ownership of their votes to demand the accountable governance required for the country to succeed.....KINDLY READ THE FULL STORY HERE▶

Peter Obi, presidential candidate of the Nigeria Democratic Congress (NDC), has called for increased citizen involvement in protecting electoral integrity. During a recent trip to Washington, D.C., Obi stated that election manipulation persists because voters frequently leave polling stations before the counting process is completed. He argued that:

  • Voters must proactively defend their ballots at polling units to ensure transparency and prevent rigging.

  • Nigeria’s fundamental obstacle is a crisis of political leadership, rather than a lack of natural or human resources.

  • Real change requires Nigerians to move beyond passive participation and take active responsibility for the electoral process.
