“Kwankwasiyya Warns: Courts Must Uphold, Not Undermine, Democracy In Nigeria”.
The Kwankwasiyya Movement has expressed concern over what it described as a troubling pattern of judicial interference in the internal affairs of political parties across Nigeria.....KINDLY READ THE FULL STORY HERE▶
The movement specifically highlighted a recent judgment by Justice Bello Kawu of the Federal Capital Territory High Court, Abuja, involving the New Nigeria People’s Party (NNPP). In a press statement on Thursday, spokesperson Dr. Habibu Sale Mohammed said, “This is not an isolated incident but part of an escalating trend in which certain judicial actions appear to overstep constitutional boundaries, produce conflicting orders, and raise serious questions about neutrality, due process, and the sanctity of the rule of law.”
The statement noted that similar interventions have occurred in the Peoples Democratic Party (PDP), Labour Party (LP), and African Democratic Congress (ADC), often resulting in confusion, factional disputes, and weakened party structures, which opportunistic actors could exploit.
The movement criticized the practice of courts issuing conflicting rulings on similar matters, entertaining cases already under appeal, and at times disregarding principles of fair hearing and procedural integrity. It warned that the apparent erosion of established legal doctrines, including stare decisis, undermines the consistency and predictability essential to the legal system.
“These developments fuel a perception that judicial processes are being drawn into political contests in ways that threaten court independence. When outcomes appear one-sided or interfere with party mechanisms, public confidence in the judiciary is inevitably weakened,” the statement said.
The Kwankwasiyya Movement emphasized that such trends pose a serious risk to Nigeria’s democracy, particularly ahead of critical elections. It warned that unchecked interference could erode trust in democratic institutions, escalate political tensions, and compromise the credibility of future elections.
The movement urged opposition parties to unite against any misuse of the judiciary aimed at weakening democratic opposition, stressing that safeguarding the rule of law is a national imperative rather than a partisan issue. It also called for the use of lawful and peaceful measures—including raising international awareness, engaging civil society, and organizing legitimate public protests—where necessary.
The statement appealed to the National Judicial Council (NJC) to urgently review and address concerns regarding conflicting and controversial judicial decisions. It further urged judicial officers to exercise restraint, uphold professionalism, and adhere strictly to fairness, due process, and constitutional principles.
Political actors were also cautioned against forum shopping and judicial manipulation to gain advantages in internal party disputes. The Kwankwasiyya Movement stressed that Nigeria’s judiciary must remain a pillar of justice and not a source of uncertainty.
“The Kwankwasiyya Movement remains committed to defending democratic values and will continue to advocate for a system where the rule of law prevails, justice is impartial, and the will of the people is respected,” the statement concluded.
