Presidency Knocks PENGASSAN, Says Tinubu Acted Within The Constitution.

The Presidency has defended President Bola Tinubu’s decision to stop revenue deductions by the Nigerian National Petroleum Company Limited (NNPCL) and other agencies, insisting the move aligns with constitutional provisions.....KINDLY READ THE FULL STORY HERE▶

In an interview with Punch, the President’s Special Adviser on Information and Strategy, Bayo Onanuga, stated that the Petroleum Industry Act (PIA) does not override the Nigerian Constitution.

Onanuga said the reaction of the Petroleum and Natural Gas Senior Staff Association of Nigeria (PENGASSAN) showed a misunderstanding of the supremacy of the Constitution over other laws.

According to him, the union focused solely on the PIA without considering that the President’s directive is rooted in constitutional authority. He maintained that no legislation, including the PIA, is superior to the Constitution.

PENGASSAN had earlier criticised the presidential directive, describing it as a breach of the PIA and warning that it could affect the company’s operations. The union argued that the order may hinder NNPCL’s ability to meet statutory obligations, including funding contributions to the Frontier Exploration Fund for planned hydrocarbon exploration in 2026.

However, the presidential spokesman dismissed the union’s stance as a hasty reaction, stressing that the Executive Order draws its legitimacy from Section 5 of the 1999 Constitution, which vests executive powers in the President to enforce laws and uphold the Constitution.

He also cited Section 44(3) of the Constitution, which grants the Federal Government ownership and control over all minerals, mineral oils, and natural gas in Nigeria.

Onanuga explained that the directive is aimed at restoring revenues meant for the Federal, State, and Local Governments, which he said were affected by provisions introduced under the PIA in 2021.

He added that the Act created legal and structural mechanisms that allowed significant Federation revenues to be deducted through various charges and fees.

Despite opposition from the union, the Presidency insisted that the order is intended to block revenue leakages and ensure that funds due to all tiers of government are fully remitted in line with constitutional requirements.

Gbenjo’s warning comes amid growing controversy surrounding the late singer’s death and burial arrangements, with reports of disagreements among members of his family.

The gospel singer spoke on Tuesday during a night of tributes held in honour of Toluwanisings in Ibadan, Oyo State. He warned against allowing the situation to degenerate into a controversy similar to the one that followed the death of Nigerian singer Mohbad.

Describing the deceased as a devoted Christian and a genuine servant of God, Gbenjo said Toluwanisings was passionate about his faith and had a good relationship with people.

He urged the public to stop fuelling unnecessary controversy over the late singer’s death, particularly through social media platforms such as TikTok and Instagram.

“You can never see Toluwani in the midst of jobless people. He had a good heart. He was a friend to everybody. He served the Lord with all his heart. Don’t turn Toluwani into Mohbad. That madness on TikTok and Instagram must stop. If you are jobless, go and look for a job,” Gbenjo said.
