El-Rufai Sues ICPC, IGP, Attorney-General, Demands ₦1 Billion.
Former Kaduna; State Governor, Nasir El-Rufai, has filed a ₦1 billion fundamental rights enforcement suit against the Independent Corrupt Practices and Other Related Offences Commission (ICPC), challenging what he described as an unlawful invasion of his Abuja residence.....KINDLY READ THE FULL STORY HERE▶
Filed at the Federal High Court in Abuja, the suit also names the Chief Magistrate of the FCT Magistrate Court, the Inspector-General of Police, and the Attorney-General of the Federation as second to fourth respondents.
Through his lawyers led by Oluwole Iyamu, El-Rufai is asking the court to declare the search warrant issued on February 4 by the Chief Magistrate, authorizing the February 19 search of his residence, as invalid, null, and void. The case is marked FHC/ABJ/CS/345/2026.
According to the suit, the search violated Section 37 of the Constitution and was “null and void for lack of particularity, drafting errors, ambiguous execution parameters, overbreadth, and absence of probable cause,” constituting an unlawful and unreasonable intrusion.
El-Rufai is seeking seven reliefs, including:
-
A declaration that the invasion and search of his residence at House 12, Mambilla Street, Aso Drive, Abuja, violated his rights to dignity, personal liberty, fair hearing, and privacy under Sections 34–37 of the Constitution.
-
A ruling that any evidence obtained from the search is inadmissible in proceedings against him.
-
An injunction preventing respondents from using any items seized during the search.
-
An order directing the ICPC and the Police to return all seized items with a detailed inventory.
-
₦1 billion in damages for psychological trauma, humiliation, distress, infringement of privacy, reputational harm, and legal costs.
The suit breaks down the damages as ₦300 million for compensatory purposes, ₦400 million as exemplary damages to deter future misconduct, and ₦300 million as aggravated damages for the oppressive nature of the search. An additional ₦100 million is sought for legal costs.
El-Rufai’s counsel argued that the warrant was fundamentally defective, lacking specificity, containing typographical errors, overbroad directives, and no verifiable probable cause. They also noted it violated provisions of the Administration of Criminal Justice Act (2015), the ICPC Act (2000), and constitutional protections against arbitrary searches.
In the affidavit supporting the suit, Mohammed Shaba, Principal Secretary to El-Rufai, said officers from the ICPC and Nigeria Police executed the search without proper legal authority, seizing documents and electronic devices, and causing humiliation and psychological trauma. He stated that no items had been returned and that the respondents continued to rely on evidence obtained through the invalid warrant.
Shaba concluded that the application was brought in good faith to enforce the former governor’s constitutional rights.

Gbenjo’s warning comes amid growing controversy surrounding the late singer’s death and burial arrangements, with reports of disagreements among members of his family.
The gospel singer spoke on Tuesday during a night of tributes held in honour of Toluwanisings in Ibadan, Oyo State. He warned against allowing the situation to degenerate into a controversy similar to the one that followed the death of Nigerian singer Mohbad.
Describing the deceased as a devoted Christian and a genuine servant of God, Gbenjo said Toluwanisings was passionate about his faith and had a good relationship with people.
He urged the public to stop fuelling unnecessary controversy over the late singer’s death, particularly through social media platforms such as TikTok and Instagram.
“You can never see Toluwani in the midst of jobless people. He had a good heart. He was a friend to everybody. He served the Lord with all his heart. Don’t turn Toluwani into Mohbad. That madness on TikTok and Instagram must stop. If you are jobless, go and look for a job,” Gbenjo said.

In the notice issued by their solicitors, Gemgold, the comedians warned members of the public against publishing or circulating allegations they described as false and defamatory against them.
The legal notice maintained that the allegations were baseless and intended to damage the reputations of the two entertainers.
