Supreme Court Affirms Ishaku As APC Candidate For Bwari Chairmanship.

In a 4–1 ruling on Monday, the apex court adopted the dissenting opinion of Justice Okon Abang, who had maintained that Ishaku was validly nominated by the party. The judgment comes just five days before the local government elections scheduled for Saturday, February 21, across the six FCT area councils.

The ruling removes Haruna Audi, who had been recognised by the Independent National Electoral Commission (INEC) as the APC candidate for Bwari.

Justice Jamilu Tukur, delivering the lead judgment, held that Ishaku’s case was not statute-barred and that the matter went beyond internal party affairs, warranting judicial intervention. The Supreme Court faulted the lower courts for miscalculating when the cause of action arose and for not properly considering affidavit evidence, ruling that time begins “from the date an aggrieved aspirant becomes aware of the wrongful act, not from undisclosed internal party actions.”

A key document, Exhibit J, an affidavit from an earlier suit showing Ishaku scored 33 votes in the APC primary, was deemed materially relevant and should have been considered.

The court also clarified that internal party remedies are not absolute. When a party violates its constitution, guidelines, or statutory safeguards—especially under Section 84(14) of the Electoral Act 2022—courts retain supervisory authority. It noted that typically, it is the losing aspirant who must exhaust internal remedies, not the declared winner.

With all issues resolved in Ishaku’s favour, the Supreme Court allowed his appeal in full, set aside the Court of Appeal’s majority judgment, and directed that his name be published as the APC candidate for Bwari.

Background: The Court of Appeal had upheld the Federal High Court’s dismissal of Ishaku’s suit as statute-barred, with Justice Okon Abang dissenting. Abang’s dissent found that Ishaku had credible evidence of winning the APC primary on June 25, 2025, and that the party’s Election Appeal Committee never reversed the result. He further held that Ishaku’s nomination was properly forwarded to INEC on July 4, 2025, and that the suit was filed within the 14-day constitutional period.

The Supreme Court’s decision endorses Abang’s reasoning, bringing the long-running pre-election dispute within the APC in Bwari Area Council to a close.

Dr Dunkwu, who served until March 7, 2026, as Deputy Chief of Staff (Legislative) to the Speaker of the House of Representatives, Abbas Tajudeen, has been at the centre of growing concerns within his community over the circumstances surrounding his passing.

The community dismissed reports suggesting that burial arrangements had already been concluded, describing them as false and misleading amid rising suspicions about how he died.

This position was contained in a joint statement issued by the Obi of Ute Okpu Kingdom, the Elders-in-Council, traditional chiefs, youth groups, the Uwizimas, and members of the Dunkwu family led by Chief Augustine Dunkwu.

According to the statement, the decision was based on cultural, legal, and emotional considerations, noting that the circumstances surrounding the death remain unclear and require proper investigation.

The community also argued that an autopsy is necessary to ensure accountability and prevent similar incidents in the future, insisting that any wrongdoing must not go unaddressed.

Citing traditional beliefs, they maintained that their customs do not permit the burial of any person whose death is surrounded by doubt, stating that truth must precede burial rites.

On legal grounds, the statement referenced standard procedures for sudden or unexplained deaths, calling for compliance with relevant coroner laws and medical protocols that require autopsy in such cases.

They further stated that once the autopsy is concluded and findings are released, a proper and dignified burial would be conducted.

The statement ended with a unified stance from all stakeholders in Ute Okpu Kingdom: “In the interest of justice, tradition, and the safety of our people, we stand united: No autopsy, no burial.”
