Appeal Court Sets Date To Hear PDP National Convention Legal Battle.

A three-member panel led by Justice Mohammed Danjuma fixed the hearing date for eight appeals challenging the Ibadan convention that produced the Tanimu Turaki-led National Executive Committee.

The appeals, filed by the pro-Seyi Makinde faction, seek to challenge the control of the party by loyalists of Minister of the Federal Capital Territory, Nyesom Wike. The Ibadan convention had deepened divisions within the PDP, splitting it into rival factions and generating conflicting court rulings.

Two Federal High Court judges in Abuja had previously restrained the PDP from holding the convention, while an Oyo State High Court granted approval for the event and directed the Independent National Electoral Commission (INEC) to monitor and recognise its outcome.

Justice Olaniran Akintola of Oyo State, in an ex-parte ruling from a suit filed by Folahan Malomo Adelabi, ordered INEC to attend and supervise the convention, preventing any action that could disrupt it.

Conversely, Justice James Omotosho of the Federal High Court in Abuja ruled that INEC should not recognise any convention conducted in breach of the law, restraining the commission from validating or uploading results of such events. Omotosho noted that while party matters are typically internal, the case involved INEC’s statutory duty to regulate and monitor party congresses and conventions.

Another related ruling by Justice Peter Lifu restrained the PDP from proceeding with the convention, citing the alleged exclusion of former Jigawa State Governor Sule Lamido from contesting the national chairmanship.

The conflicting rulings escalated the PDP’s internal crisis, setting the stage for the appellate court to resolve the disputes. The Court of Appeal will examine all claims and counterclaims in the eight appeals and deliver a conclusive judgment on February 12.
