Constitutional Lawyer Rejects Sharia Council’s Demand To Sack INEC Chairman.

Speaking in Abuja on Sunday, Prof. Hon said the council’s claim that the INEC chairman shows bias against a particular interest is both “ridiculous” and an attempt to pressure President Bola Tinubu to violate the 1999 Constitution.
He explained that, under Sections 157(1) and (2) of the Constitution, the INEC chairman can only be removed by the President acting on a two-thirds Senate vote, and strictly for “inability to discharge the functions of office” or “misconduct.” Prof. Hon emphasized that no public opinion or prior statements can justify his removal.
“The Sharia Council’s reasons are neither constitutionally nor empirically valid,” he said, noting that Prof. Amupitan has not committed any actions that meet the constitutional criteria for removal.
Prof. Hon further highlighted that the INEC chairman’s appointment followed proper constitutional procedures: he was nominated by the President, approved unanimously by the National Council of State, and confirmed by the Senate on October 16, 2025. He also noted that many Muslims were involved in these approvals, and no objection was raised at the time.
He criticized the council’s objection as an afterthought linked to Prof. Amupitan’s condemnation of violence against Christians, insisting that such a stance does not disqualify him from office.
Prof. Hon concluded by urging Prof. Amupitan not to resign in response to the council’s claims, warning that doing so would set a dangerous precedent. He encouraged the INEC chairman to view the allegations as a call to uphold justice, fairness, and neutrality in office.
