Supreme Court Backs Jail Term For Lamido’s Son Over Cash Scandal.

The Supreme Court of Nigeria has dismissed the appeal filed by Aminu Sule Lamido, son of former Jigawa State Governor, Sule Lamido, challenging his conviction for failing to declare $40,000 at an airport.....KINDLY READ THE FULL STORY HERE▶

In a unanimous decision delivered on Friday by a five-member panel, the apex court resolved all three issues raised for determination against the appellant, ruling that the appeal lacked merit.

The lead judgment, written by Justice Adamu Jauro and read by Justice Abubakar Umar, affirmed the decision of the Court of Appeal, Kaduna Division, which had earlier upheld Aminu Lamido’s conviction by the Federal High Court in Kano.

The Supreme Court agreed with the findings of the lower courts that the prosecution had successfully established the charges brought against him by the Economic and Financial Crimes Commission.

Aminu Lamido was prosecuted for failing to declare foreign currency and for making false declarations at the airport, contrary to applicable financial regulations.

In its judgment delivered on July 12, 2015, the Federal High Court in Kano found him guilty and ordered the forfeiture of 25 per cent of the undeclared foreign currency to the Federal Government.

The Court of Appeal subsequently upheld the conviction, leading to the appeal before the Supreme Court. However, the apex court ruled that there was no justification to overturn the concurrent findings of the two lower courts, thereby bringing the legal battle to a close.

Background on Conviction

Bolarinwa has been serving a prison sentence following his initial remand in April 2022 by the Economic and Financial Crimes Commission (EFCC).

  • He was arraigned before Justice Oluwatoyin Taiwo of the Special Offences Court in Ikeja on a 13-count charge encompassing forgery, possession of false documents, and obtaining money by false pretences amounting to ₦266.5 million.

  • The EFCC stated that Bolarinwa deceived Kodef Clearing Resources Limited by posing as a military general and claiming that former President Muhammadu Buhari had shortlisted him for appointment as Chief of Army Staff, extracting large sums to “facilitate” the role.

  • Investigators also recovered forged appointment letters, military identification cards, recommendations bearing former President Olusegun Obasanjo’s name, and several firearms from his Alagbado residence.

  • Although he initially pleaded not guilty, Bolarinwa changed his plea to “guilty” during court proceedings on July 7, 2022.

  • Justice Taiwo convicted him on all 13 counts, sentencing him to seven years’ imprisonment without the option of a fine, ordering asset forfeitures, and directing him to pay ₦20 million in restitution.
