Rivers Assembly Alleges Plot To Use Outside Courts To Block Impeachment Process.
The Rivers State House of Assembly has raised concerns over alleged attempts by certain individuals to approach High Courts outside the Port Harcourt Judicial Division to secure ex-parte orders aimed at obstructing the Assembly from performing its constitutional duties. According to Nivo News, the alert comes amid the ongoing impeachment process against Governor Sim Fubara.....KINDLY READ THE FULL STORY HERE▶
In a statement issued on Sunday and signed by Dr. Enemi Alabo George, Chairman of the House Committee on Information, Petitions, and Complaints, the Assembly claimed it had received credible intelligence regarding the purported schemes. The statement noted that those allegedly involved were fully aware of constitutional provisions, including Section 272(5), which grants the Federal High Court jurisdiction over questions about the tenure of state governors or assembly members, and Section 188(10), which restricts courts from entertaining proceedings relating to the actions of the House.
The Assembly further highlighted previous judicial pronouncements that invalidated similar ex-parte orders by Rivers State High Courts, stressing that any attempt to circumvent the law would be improper. Members were urged to exercise restraint and adhere to constitutional processes, responding directly to the Notice of Allegations of Gross Misconduct rather than relying on external courts or media campaigns to challenge the Assembly.
The statement concluded by reaffirming the Assembly’s commitment to the Constitution and the rule of law, emphasizing that any attempts to subvert legal procedures would be resisted.

She wrote, “A delegate-based process was introduced to be conducted at a central location, replacing the direct primaries that were supposed to be held at Local Government headquarters. She continued, “The party will indeed go on to release numerous statements claiming the Abuja FCT primaries were free and fair. They are entitled to their voice, but the facts that transpired, when litigated by conscience and the guidelines of the Electoral Act, do not reflect justice and fairness.”
