Osun APC Alleges State Government Behind Local Government Crisis, Calls On NJC

According to Nivo News, the Osun State chapter of the All Progressives Congress (APC) has accused the state government of deliberately creating legal crises to destabilize elected local government officials, calling on the National Judicial Council (NJC) to intervene urgently.....KINDLY READ THE FULL STORY HERE▶

Speaking at a press conference in Osogbo, APC Chairman Tajudeen Lawal said the controversy arose from a Court of Appeal judgment delivered on February 10, 2025, which nullified an earlier ruling that had removed APC chairmen and councillors across the state. Lawal noted that the state government did not appeal the decision but allegedly ignored it, prompting the reinstated officials to resume duties on February 17, 2025.

Lawal alleged that coordinated attacks on the reinstated officials followed, resulting in the death of Hon. Remi Abbas, then Chairman of Irewole Local Government. He further accused the Nigeria Union of Local Government Employees (NULGE) of collaborating with the state government to compel workers to stay away from their duties.

He also criticized a local government election held on February 22, 2025, by the state government, describing it as legally flawed and challenged in court by the APC. Lawal claimed the government subsequently filed multiple lawsuits in different courts over the same matter, undermining the Court of Appeal’s decision.

According to Lawal, an Osun State High Court ruling on February 21, 2025, ordering fresh elections, was an attempt to circumvent the appellate judgment. The APC responded by filing a suit to set aside the decision and petitioning the NJC. Lawal added that NULGE separately sought recognition of PDP candidates as council officials, while the state government obtained an interim order at the Federal High Court on May 15, 2025, to restrict the release of local government funds.

Lawal highlighted that the Court of Appeal reaffirmed its February 19, 2025 judgment on June 13, 2025, confirming the reinstatement of APC officials. He also noted that a Federal High Court suit filed by the state government in Abuja was struck out on October 29, 2025, and that the Supreme Court on December 5, 2025, struck out further suits, affirming the validity of the appellate judgment and nullifying the February 22, 2025 local government elections.

Despite the apex court ruling, Lawal alleged that the state government continued to file cases in lower courts, threatening judicial consistency and the rule of law. He clarified that the reinstated chairmen and councillors had not sought to extend their tenure but only sought judicial interpretation regarding its duration under Osun State law.

Lawal accused the state government of misleading the public and federal authorities through selective interpretations of court judgments and alleged withholding of local government funds. He urged the NJC to take swift action on petitions against judges involved, emphasizing that timely intervention would strengthen public confidence in the judiciary and discourage violence.

The APC chairman commended the judiciary, law enforcement agencies, and the media for their professionalism during the disputes and thanked Osun residents for maintaining law and order throughout the crisis.

Deregistration Drama: Courtroom Showdown Over ADC And Accord Party Hits A New Delay!.

Published

  • Case Adjournment: The Court of Appeal in Abuja has postponed the hearing of an appeal regarding the potential deregistration of the African Democratic Congress (ADC), Accord Party, and three other political parties until July 7.....KINDLY READ THE FULL STORY HERE▶

    • Procedural Delay: The court moved the hearing date from June 25 to allow the involved parties sufficient time to file and exchange their briefs of argument.

    • Reasoning for New Date: Although Accord Party counsel, Musibau Adetunbi (SAN), requested a three-day window to file, Justice Abubakar Mohammed explained that the panel’s upcoming official commitments necessitated selecting July 7 as the earliest available date.

    • Background of the Dispute: The appeal follows a Federal High Court ruling by Justice Peter Lifu, which ordered the Independent National Electoral Commission (INEC) to deregister the ADC, Accord Party, Action Peoples Party (APP), Action Alliance (AA), and Zenith Labour Party (ZLP) for allegedly failing to meet constitutional performance benchmarks.

    • INEC’s Position: INEC has challenged this deregistration order, arguing that these parties met the necessary constitutional thresholds by securing elective positions in previous elections and providing certificates of return as evidence.

    • Stay of Execution: On June 16, the Court of Appeal previously ordered a stay of execution on the Federal High Court’s judgment, preventing INEC from proceeding with the deregistration until the current appeal is decided.

    • Procedural Criticism: The appellate court had previously criticized Justice Lifu for ignoring an earlier order to suspend proceedings, noting that such an action undermined the established hierarchy of the courts.

    • Origin of the Suit: The original legal challenge was filed by the National Forum of Former Legislators, who argued that these specific parties failed to meet the electoral performance standards required by the 1999 Constitution and the 2022 Electoral Act.
