‘Nnamdi Kanu’s Trial, calculated Effort To Force Conviction In absence Of law’ – Defence Team

In a statement signed by Barrister Onyedikachi Ifedi, the consortium, a group of lawyers advocating for Kanu’s release, claimed that the Nigerian government’s prosecution “engineered a trial without law” in his case.

Kanu was sentenced to life imprisonment on November 20, 2025, by an Abuja Federal High Court, presided over by Justice James Omotosho, following his conviction on terrorism charges. He is currently serving his sentence at Sokoto Prison.

The consortium stated that Kanu’s trial violated fundamental legal principles, noting that the prosecution failed to cite the specific law under which he was tried and convicted. “It was a calculated effort to force a conviction to survive the absence of law,” the statement read.

Highlighting events from November 4, 2025, when Kanu represented himself, the group said: “A Nigerian Federal High Court in Abuja continued a criminal trial without identifying the law under which the accused was being tried. The court admitted that the Constitution forbids conviction without such a law, deferred the matter to ‘final address,’ and then abolished final address altogether. It was institutional intransigence — a judge and a prosecutor working in tandem to circumvent the law.”

The defence emphasised that during the proceedings, Kanu repeatedly asked, “My Lord, please show me the law under which I am being tried,” a question that went unanswered. “At no point did Justice Omotosho name an extant statute, identify an operative section, explain which law survived repeal, or state which written law justified detention,” the statement added.

According to the defence, the trial breached Section 36(12) of the Constitution, which stipulates that no person shall be tried or convicted unless the offence is defined by written law. “Trial itself is barred where no law exists. You cannot begin a defence and later check if a crime exists. Detention without law cannot be constitutionally justified. This was not ignorance; it was a deliberate manipulation of the Constitution to keep the trial alive,” the statement said.

The consortium also disputed claims that no evidence was presented regarding Kanu’s alleged extraordinary rendition. “This is demonstrably false. Rendition was pleaded on affidavit, appellate courts had ruled on it, and Omotosho cited the Kenyan judgment condemning extraordinary rendition but ignored the evidence before him. Even the Supreme Court (Agim JSC concurring) described it as state criminality,” the statement concluded.
