EFCC Detains Malami Illegally, Lawyer Says Bail Conditions “Oppressive”.

The legal team representing former Attorney General of the Federation and Minister of Justice, Abubakar Malami, has condemned his ongoing detention by the Economic and Financial Crimes Commission (EFCC), describing it as unlawful and unconstitutional.....KINDLY READ THE FULL STORY HERE▶

Speaking on behalf of Malami, Barrister Mohammed Sheriff Elhassan stated that the lawyers are seeking judicial intervention to end what they termed “unconstitutional detention.” He criticized the conditions attached to Malami’s release as “oppressive and unattainable,” insisting that the former AGF has fully cooperated with the anti-graft agency and never failed to respond to invitations or “jumped bail.”

Elhassan explained that Malami voluntarily submitted himself for questioning from November 24 to November 29, and again on December 1 and December 8, 2025. Following extensive interrogations, Malami was initially granted administrative bail, which he reportedly complied with.

However, the lawyer claimed that the EFCC revoked this bail on December 2, 2025, and continued to detain Malami. He emphasized that the investigation pertains to alleged mismanagement of recovered Abacha funds, not terrorism, as suggested by some reports.

Elhassan further highlighted that Malami’s continued detention beyond the constitutionally permitted 24-hour period without a valid court order constitutes a violation of the Nigerian Constitution. “It is irrational to continue to detain a person who has obeyed all invitations and fully cooperated with investigators,” he said.

The legal team is now pursuing court action to secure Malami’s immediate release and ensure his constitutional rights are upheld.
