The recent verdict of the Property Tribunal in London regarding the ownership of No. 79 Randall Avenue, Neasden, North London, has captured widespread attention in Nigeria. The dispute involved Professor Mike Ozekhome and a claimant identified as Ms. Tali Shani, who opposed Ozekhome’s registration of the property. The tribunal determined that neither claimant existed in reality, dismissing both claims as fabricated. It established that the property was originally purchased in 1993 by the late General Jeremiah Useni, who was deemed the sole legal and beneficial owner. The judgment confirmed that the transfer of the property to Professor Ozekhome was orchestrated with General Useni’s knowledge and consent, dismissing any suggestion that Ozekhome had attempted to seize the property unlawfully.
The tribunal noted that some documents and testimonies submitted by Ozekhome and his son were “contrived” and “invented.” However, legal experts stress that allegations of criminal conduct, including perjury or forgery, require proof beyond a reasonable doubt, including evidence of intent or “guilty mind” (mens rea). The tribunal explicitly found no evidence that Ozekhome acted with fraudulent intent, effectively exonerating him.
Legal analysts argue that public perception of wrongdoing stems more from sentiment than law, noting that neither Ozekhome nor his son can be held liable for actions arising from claims made by fictitious individuals. The proceedings underscore that the law demands both factual and mental elements to establish a crime, and in their absence, an accused person remains innocent.
Observers highlight that Ozekhome has been unfairly vilified despite acting in accordance with the wishes of General Useni. Any missteps, they argue, were errors of judgment rather than intent, and he remains a figure deserving of public sympathy.
