Osun Vs FG: Apex Court Reserves Judgment In Fierce Legal Clash Over LG Allocations.

The Supreme Court has reserved its judgment in a high-profile legal battle between the Attorney General of Osun State and the Attorney General of the Federation (AGF) over the controversial withholding of statutory allocations meant for Local Governments in the state.....KINDLY READ THE FULL STORY HERE▶

According to Nivo News, the suit, marked SC/CV/773/2025, seeks an order restraining the AGF from directing the Central Bank of Nigeria (CBN) to release the withheld allocations to Local Government Chairmen and Councillors elected on the platform of the All Progressives Congress (APC).

A seven-member panel of the apex court, led by Justice Uwani Abba-Aji, listened to final arguments from both parties on Tuesday before announcing that judgment had been reserved to a date that will be communicated later.

Leading the Osun State legal team was Musbau Adetunbi (SAN), while Akin Olujimi (SAN) and Tijani Gazali (SAN), Acting Director of Civil Appeals at the Federal Ministry of Justice, appeared for the AGF.

Adetunbi told the court that the plaintiff filed the originating summons on August 25, posing six key legal questions and seeking ten distinct reliefs. He explained that while the case was pending, the AGF allegedly attempted to tamper with the subject of the dispute by authorizing the transfer of the withheld funds from the CBN to a private bank. However, a court order was obtained to halt the release.

He urged the Supreme Court to grant all reliefs sought and dismiss the AGF’s preliminary objections, arguing that the defendant’s actions could jeopardize justice.

In his defense, Olujimi challenged the competence of the suit, arguing that it lacked merit, fell outside the court’s original jurisdiction, and did not establish sufficient legal standing for the plaintiff. He maintained that the matter was essentially a political dispute between two parties and related to the tenure of Local Government officials.

The AGF’s counsel further contended that multiple cases had already been filed in different courts on the same issue, amounting to an abuse of judicial process. He added that since the tenure of the disputed APC Chairmen and Councillors would expire on October 22, it was appropriate for the funds to be released to them to run the councils.

The Osun Attorney General, however, argued that the allocations should instead be released to Chairmen and Councillors elected under the Peoples Democratic Party (PDP), as the election that produced the APC officials had been nullified by a Federal High Court and upheld by the Court of Appeal in Abuja.

He further asked the Supreme Court to restrain the AGF from withholding or suspending statutory allocations to the 30 Local Governments, insisting that the AGF acted improperly by recognizing the APC officials despite existing court judgments.
