The crisis erupted after Minority Leader Rt. Hon. Kingsley Chinda filed a lawsuit against all minority parties in the House, alleging attempts to remove him without following due process, in violation of the 1999 Constitution and the standing orders of the chamber.
In response, the Federal High Court in Abuja, presided over by Justice J.O. Abdulmalik, issued an interim injunction directing all parties—including the National Assembly and House leadership—to maintain the status quo until the case is resolved.
The notice of the emergency session, jointly signed by PDP Caucus Leader Hon. Agbedi Frederick, Labour Party’s Hon. Afam Victor Ogene, NNPP’s Hon. Muktar Umar-Zakari, and YPP’s Hon. Peter Uzokwe, directed all minority lawmakers to attend, stressing the need to deliberate on Chinda’s lawsuit and prepare a collective response.
Chinda’s legal action, filed through Dr. J.Y. Musa (SAN), seeks to restrain the National Assembly, its clerks, the Speaker, and the leadership of the minority parties from effecting his removal without adherence to established legal procedures. He also prays the court to reject any recognition of moves by individuals or groups to oust him.
Justice Abdulmalik, in his ruling, emphasized the necessity of upholding constitutional rights under Section 36(1) of the 1999 Constitution and ordered that all parties maintain peace until the substantive motion is determined on merit. The Judge directed that all defendants be promptly served with notices and relevant filings to avoid prejudicing the outcome of the case.
This development follows allegations that some members of the Minority Caucus were plotting to remove Chinda over his alleged closeness to the Minister of the Federal Capital Territory, Nyesom Wike. The matter is expected to dominate discussions as the House reconvenes this week.
