NERC Drops Bombshell: Any State Reducing Electricity Tariffs Must Foot the Subsidy Bill”

This clarification came in response to the recent controversy over the Enugu Electricity Regulatory Commission’s (EERC) decision to reduce tariffs for Band A customers.
In a notice released on Thursday, NERC advised state governments to fully reflect the wholesale cost of electricity in their approved tariffs or be ready to provide subsidies to cover any resulting shortfalls.
The commission acknowledged that states that have assumed regulatory control over their intrastate electricity markets are permitted to design their own tariff structures for end‑users. However, it stressed that such powers must not disrupt the operations or financial stability of the broader electricity market.
It further warned that a state’s authority over tariffs only applies when it is generating and transmitting electricity independently.
NERC stated:
“Since states have no jurisdiction over the national grid or power plants established under federal laws or operating under licences issued by the commission, they must fully account for the wholesale cost of grid supply in their tariffs for end‑users. Any shortfall that distorts wholesale generation, transmission, or legacy financing costs in the Nigerian Electricity Supply Industry (NESI) must be offset by a subsidy.”
The regulator emphasized that no institution has the mandate to take actions that would endanger the stability of the national grid or the wholesale electricity market, as such would contravene constitutional provisions.
NERC’s statement followed concerns raised over EERC’s Tariff Order (Order No. EERC/2025/003), which applies to its licensee, Mainpower Electricity Distribution Limited (MEDL)—a company that depends entirely on supply from the national grid.
According to NERC, the order slashed Band A tariffs in MEDL’s network to ₦160.4 per kWh and froze tariffs for other bands, despite ongoing wholesale generation, transmission, and legacy financing costs. It noted that this figure was reached by cutting the average generation tariff from ₦112.60 per kWh to ₦45.75, creating a subsidy gap of ₦66.85 per kWh.
Citing Section 34(1) of the Electricity Act (EA), NERC reiterated its statutory responsibility to maintain an efficient and financially sustainable electricity industry—an obligation that also applies to subnational regulators such as EERC.
The commission added that it is engaging with EERC to clarify any misunderstandings regarding wholesale generation and transmission costs on power imported from the national grid. It assured stakeholders of its commitment to ensuring full cost recovery in line with Nigerian law.
Meanwhile, the Association of Nigerian Electricity Distributors (ANED) and the Association of Power Generation Companies (APGC) cautioned that neither the Enugu Electricity Distribution Company nor other states should reduce tariffs until they are independently generating and transmitting electricity.
