Drama in Benue! Court Nullifies Chief Judge’s Sack, Tears Into Assembly and Governor

In a landmark judgment, Justice Osatohanmwen Obaseki‑Osaghae also struck out a recommendation by Governor Hyacinth Alia for the Chief Judge’s removal, describing it as a clear breach of constitutional provisions.
Delivering judgment in suit NICN/ABJ/68/2025, filed by Justice Ikpambese, the court held that neither the Governor nor the House of Assembly has the authority to remove a Chief Judge without the involvement of the National Judicial Council (NJC).
“The actions of the Governor and the House of Assembly, taken without prior investigation and the concurrence of the NJC, are unconstitutional, null and void,” the court ruled.
The judge further declared that Speaker Hyacinth Dajoh had no legal basis to announce the Chief Judge’s removal without following due process as stipulated under Section 292 of the 1999 Constitution (as amended).
In a significant directive, the court also restrained the NJC from acting on any petition forwarded by Governor Alia or the Benue State Attorney General seeking to investigate or discipline Justice Ikpambese.
Justice Obaseki‑Osaghae emphasised that the judge’s removal violated fundamental principles of fair hearing and constitutional safeguards:
“The defendants breached Section 292(1)(a)(ii) of the Constitution and the relevant Standing Orders of the Benue State House of Assembly,” the court held.
The court issued a perpetual injunction barring the House of Assembly, its Speaker, the Attorney General of the state, and Governor Alia from initiating or permitting any action aimed at removing or suspending Justice Ikpambese without due constitutional procedure.
Additionally, the February 18, 2025 press release issued by 13 lawmakers announcing the Chief Judge’s removal was also declared invalid.
The suit, filed by Ikpambese through his counsel Prof. Sebastine Hon (SAN), listed as defendants: the National Judicial Council (NJC), the Attorney General of the Federation and Minister of Justice, the Benue State House of Assembly, the Speaker of the Assembly, the Attorney General of Benue State, and Governor Hyacinth Alia.
All preliminary objections challenging the competence of the suit were dismissed, with the court affirming that Justice Ikpambese was entitled to all the reliefs sought.
