Canada Denies Ex-Nigerian Cop Residency, Judge Calls NPF ‘Ruthless And Corrupt’

According to NIVONEWS, Eriator had earlier been denied permanent residency by Immigration, Refugees and Citizenship Canada (IRCC), prompting him to seek judicial intervention. However, the court upheld the decision, with Justice Roy declaring that the Nigerian police systematically engaged in crimes that violated international law.
“The Nigerian police force maintained a culture of rape, torture, enforced disappearances, and extrajudicial killings,” the judge noted, adding that these acts contravened the Rome Statute on crimes against humanity. He ruled that Mr Eriator, by remaining in the police and rising through its ranks, was complicit in these violations. “Given his role, and the context, the Minister rightly concluded that he made a significant contribution to the crimes,” the court held.
Mr Eriator denied any wrongdoing, insisting he had merely served as a police officer and was never involved in any of the alleged atrocities. But Justice Roy maintained that his continued service, particularly in units such as the now-disbanded Special Anti-Robbery Squad (SARS), implicated him under the principle of individual accountability.
According to NIVONEWS, Mr Eriator entered Canada illegally in October 2017 via the U.S. land border. He joined the Nigerian police in 2009, attaining the rank of corporal before resigning in 2016. During his time in the force, he served at various checkpoints and participated in election security operations, including during the 2015 presidential election. He also had a stint with SARS in Ikeja, a unit globally condemned for its abuses.
Justice Roy’s verdict adds to a growing list of Canadian judicial decisions denying asylum or permanent residency to former Nigerian police officers over alleged complicity in systemic rights violations.
According to NIVONEWS, other similar cases include that of Olushola Popoola, a former SARS operative whose asylum request was dismissed in 2021 by Justice Sébastien Grammond, and Charles Ukoniwe, who was denied by Justice Patrick Gleeson due to his ties with the Mobile Police (MOPOL) unit.
In his ruling, Justice Gleeson emphasized that under both Canadian law and the UN Convention Relating to the Status of Refugees, any individual who voluntarily served in the Nigerian police may be deemed inadmissible solely on the basis of their affiliation, regardless of personal involvement in specific crimes.
