Supreme Court Slams Gavel: Okpebholo Stays Governor, Opposition Defeated

According to NIVONEWS, the apex court’s five-member panel, led by Justice Mohammed Garba, ruled that the appellants failed to provide sufficient, credible, and admissible evidence to substantiate claims of electoral malpractice—including allegations of over-voting and substantial non-compliance with the Electoral Act during the September 21, 2024, governorship election.
The court upheld the previous decisions of both the Edo State Governorship Election Petition Tribunal and the Court of Appeal, which had declared Okpebholo of the All Progressives Congress (APC) as the lawfully elected governor.
Reading the lead judgment, Justice Garba stated that the PDP and Ighodalo could not prove their allegations, noting that several documents—particularly BVAS machines—were merely submitted without any demonstrative linkage to alleged irregularities in 432 of the 4,519 polling units.
“The appellants did not satisfactorily discharge the burden of proof placed on them by law,” the panel concluded.
According to NIVONEWS, Ighodalo had approached the Supreme Court under appeal number SC/CV/536/2025, seeking to overturn the May 29, 2025, judgment of the Court of Appeal, which also dismissed his claims. He argued that the lower courts failed to properly evaluate his petition and called for the Supreme Court to declare him the true winner of the election, insisting he garnered the highest number of valid votes.
However, the Independent National Electoral Commission (INEC), Governor Okpebholo, and the APC countered the appeal, urging the Supreme Court to uphold the election results announced by INEC.
According to NIVONEWS, the tribunal had earlier dismissed three separate petitions — from the PDP, the Action Alliance (AA) led by Adekunle Rufai Omoaje, and the Accord Party with its candidate Dr. Bright Enabulele — affirming Okpebholo’s mandate with 291,667 votes, against Ighodalo’s 247,655 votes.
The petitioners had claimed widespread irregularities, including flawed result collation in 765 polling units and non-compliance with the Electoral Act 2022, alleging that INEC’s failure to serialize or pre-record sensitive materials facilitated rigging.
They tendered 153 BVAS machines from 133 polling units and presented 19 witnesses. However, both the tribunal and appellate courts ruled that most of their witnesses gave hearsay testimonies and that no credible polling unit agents or presiding officers were presented to verify the allegations.
The Supreme Court’s final ruling, aligning with the lower courts, emphasized that the burden of proof was not met, bringing an end to the legal battle over Edo’s governorship election.
