According to reports, the plaintiffs—Adeyemi Emmanuel, Ayodeji Victor Tolu, and Haruna Ismaila—are asking the court to invalidate the interim leadership arrangement, which they argue violates the party’s constitution and disregards a previous court ruling.
Central to the lawsuit is the allegation that the handover of the ADC’s leadership to individuals involved in a broader opposition merger—allegedly aimed at forming a united front against President Bola Tinubu ahead of the 2027 elections—is unconstitutional and breaches an existing court judgment.
The suit, numbered FHC/ABJ/CS/1328, lists the ADC as the 1st defendant, the Independent National Electoral Commission (INEC) as the 2nd defendant, and Ralph Nwosu, the party’s immediate past National Chairman, as the 3rd defendant.
Also joined in the suit are Senator David Mark (4th defendant), recently named Interim National Chairman; former Osun State Governor Rauf Aregbesola (5th defendant), serving as Interim National Secretary; and former Sports Minister Bolaji Abdullahi (6th defendant), now Interim National Publicity Secretary.
The plaintiffs are asking the court to determine whether the appointment of the interim executives complies with the ADC Constitution (2018, as amended). They also challenge the eligibility of Mark, Aregbesola, and Abdullahi, citing their alleged failure to properly register with the party and questioning whether the party’s constitution even provides for interim positions.
The suit specifically asks:
“Whether or not the appointment of the 4th, 5th, and 6th Defendants… was made in breach of the provisions of the African Democratic Congress (ADC) Constitution, 2018 (as amended).”
Additionally, the plaintiffs have called into question INEC’s recognition of the interim leadership and urged the court to nullify the transfer of power by Ralph Nwosu, which they argue contravenes a judgment delivered by Justice Binta Nyako in Suit No. FHC/ABJ/1541/2022 on December 21, 2022.
This legal dispute threatens to fracture a budding opposition alliance—reportedly backed by former Vice President Atiku Abubakar—which recently selected the ADC as its political platform to challenge the ruling APC in the 2027 general elections.
Following the coalition’s formation, Ralph Nwosu announced the dissolution of all existing party structures to accommodate the newly constituted interim leadership.
The plaintiffs are seeking multiple reliefs, including a declaration that the interim leadership is “unconstitutional, unlawful, null and void,” and an injunction restraining INEC from recognising the new appointments.
