Federal Court Sets June 25 Hearing in DSS Suit Against Utomi Over ‘Shadow Government’ Allegations
The Federal High Court in Abuja has scheduled a June 25 hearing in a case brought by the Department of State Services (DSS) against Professor Patrick Utomi, former presidential candidate of the African Democratic Congress. The suit accuses Utomi of attempting to establish a “shadow government” in Nigeria, which the DSS argues is unconstitutional and threatens national security.....KINDLY READ THE FULL STORY HERE▶
Justice James Omotosho granted an ex parte motion allowing court papers to be served on Utomi at his Lagos residence via courier, following a request from DSS lead counsel, Akinlolu Kehinde (SAN).
In suit number FHC/ABJ/CS/937/2025, the DSS seeks a perpetual injunction restraining Utomi and his associates from forming or operating any entity resembling a shadow cabinet. The agency contends that such actions undermine the supremacy of the 1999 Constitution and could incite unrest or fuel separatist ambitions.
The DSS cited public statements and social media activity from Utomi’s group, which allegedly includes the appointment of roles such as Ombudsman and members of a Policy Delivery Unit. These actions, it claims, mislead the public and could erode confidence in the elected government.
Utomi has yet to formally respond to the allegations. The court will reconvene on June 25, 2025, to begin hearing the matter.
