Lawyers Demand Probe into Alleged $4bn Mismanagement Under Mele Kyari’s Tenure
A coalition of legal practitioners under the platform of Guardians of Democracy and Rule of Law has submitted a petition to the Minister of Finance, Wale Edun, seeking the establishment of a judicial commission of inquiry to investigate Mele Kyari’s tenure as former Group Chief Executive Officer of the Nigerian National Petroleum Company Limited (NNPCL).....KINDLY READ THE FULL STORY HERE▶
Led by Barrister Benjamin Theophilus, the group accused Kyari of corruption, abuse of office, tax evasion, and the misappropriation of over $4 billion allegedly spent on refinery rehabilitation projects.
The petition raised concerns about the significant inflation of costs for the refurbishment of the Port Harcourt, Warri, and Kaduna refineries. It referenced a private consortium’s offer to overhaul all three refineries — with a combined daily capacity of 445,000 barrels — for $1 billion, contrasting this with the NNPCL’s expenditures: $1.5 billion each on Port Harcourt and Warri, and $1 billion on Kaduna Refinery. The group argued that a new 600,000-barrel-per-day refinery could have been constructed for just $500 million.
Additional accusations against Kyari included collusion with consultants and contractors to obscure project costs and evade taxes. The lawyers further cited irregularities in crude oil allocation, revealing that 80,000 barrels per day were allegedly diverted under a so-called “pipeline security” arrangement lacking transparency. They also flagged the AKK Gas Pipeline Project, valued at $5 billion, for suspicious contractual practices and stalled progress despite full funding.
The petition also pointed to anomalies in fuel subsidy claims, with the NNPCL reportedly ramping up petroleum imports in 2020 despite global declines in demand due to the COVID-19 pandemic. Furthermore, the group questioned the rationale behind $21.565 billion in crude-backed loans secured since 2019, which they said unfairly transferred trading profits to international firms at Nigeria’s expense.
The lawyers are calling for the urgent recovery of misappropriated funds and a partnership with the Federal Inland Revenue Service to investigate tax violations. They insisted that the inquiry should be led by retired Supreme Court justices to ensure an impartial review of NNPCL’s operations over the past five years.
Their petition follows a protest staged by the group, demanding accountability and reform within Nigeria’s petroleum industry.
