Court Postpones ALGON’s Autonomy Lawsuit Against FG, States Over Judge’s Absence

Published

on

The Federal High Court in Abuja on Tuesday postponed the hearing in a high-stakes lawsuit filed by the Association of Local Governments of Nigeria (ALGON) against the Federal and State Governments. The delay occurred due to the absence of the presiding judge, Justice Inyang Ekwo. The matter, initially scheduled for mention, has now been adjourned to May 29, 2025.....KINDLY READ THE FULL STORY HERE▶

ALGON is taking legal action against the Attorney-General of the Federation, the Federal Republic of Nigeria, and 23 others, including the Minister of Finance, the Central Bank of Nigeria (CBN), state Commissioners for Finance, the Minister of Budget and National Planning, the Accountant-General of the Federation, the Revenue Mobilisation Allocation and Fiscal Commission (RMAFC), the Nigerian National Petroleum Corporation (NNPC), multiple commercial banks, and one Bello Lawal.

At the heart of the lawsuit is the non-implementation of the Supreme Court judgment delivered on July 11, 2024, which ordered the enforcement of financial autonomy for local governments. Nearly nine months since the verdict, ALGON contends that the Federal Government has failed to ensure full compliance.

In the suit marked FHC/ABJ/CS/353/2025, ALGON seeks a declaration compelling the inclusion of all 774 local government councils in the Federation Account Allocation Committee (FAAC) proceedings. They also request a ruling barring the first to eighth defendants from disbursing funds to local councils through the ninth to 23rd defendants without ALGON’s consent — in accordance with the Supreme Court’s decision.

ALGON accuses key government entities and commercial banks of undermining the ruling by continuing indirect fund disbursements, thus frustrating local government autonomy.

Represented by legal counsel Okechukwu Azorji, ALGON argues that its mandate, as a legally incorporated body since May 10, 2002, empowers it to defend local government interests.

However, the CBN, represented by Senior Advocate of Nigeria (SAN) Sam Ologunorisa, filed a preliminary objection challenging the court’s jurisdiction and ALGON’s legal standing, claiming that ALGON is not a constitutionally recognized body and was not a party to the original Supreme Court case.

Similarly, FAAC’s counsel, Olawale Fapohunda (SAN), and lawyers for state Finance Commissioners also raised objections, stating that ALGON lacks the legal authority to initiate the suit. They further argued that the Allocation of Revenue (Federation Account, etc.) Act of 1982 does not provide for local government representation in FAAC deliberations.

In response, ALGON has submitted a counter-affidavit defending its legal status and reiterating its right to seek enforcement of local government autonomy as established by the Supreme Court.

The case continues to draw national attention as stakeholders await the next hearing date in May.

Momodu Defends Atiku Amid Age Criticism Ahead Of 2027 Presidential Contest.

Published

ADC chieftain and publisher, Dele Momodu, has dismissed calls for former Vice President Atiku Abubakar to withdraw from the 2027 presidential race, describing the push as unfair and politically motivated.....KINDLY READ THE FULL STORY HERE▶

Momodu was reacting to comments by activist Zekeri Idris Jnr, a supporter of Peter Obi, who urged Atiku to step aside over concerns about his age, which would be about 80 by 2027.

In a post on his X handle on Saturday, Momodu said attention should be focused on holding the government accountable rather than targeting Atiku’s political ambition.

The exchange followed a viral video where Idris insisted that Atiku should support younger aspirants instead of contesting, arguing that voters would not back an elderly candidate.

Idris also suggested that Atiku should act as a statesman and support younger politicians such as Rabiu Musa Kwankwaso and others.

Responding, Momodu cited several world leaders who held office at advanced ages, arguing that experience should not be dismissed in leadership discussions.

He questioned what should disqualify Atiku from contesting, insisting that age alone is not a valid reason.

Atiku, who lost the 2023 presidential election to President Bola Tinubu, is reportedly considering another run in 2027 under the African Democratic Congress (ADC).
