Court Delays ALGON’s Autonomy Suit Against FG, States to May 29
The Federal High Court in Abuja has adjourned a significant lawsuit filed by the Association of Local Governments of Nigeria (ALGON) against the Federal and State Governments. The case, which centers on enforcing financial autonomy for local governments, was scheduled to be heard by Justice Inyang Ekwo but could not proceed due to the court’s non-sitting. ALGON, acting through its Registered Trustees, filed the suit referenced as FHC/ABJ/CS/353/2025 in reaction to what it described as the states’ failure to comply with a Supreme Court ruling delivered on July 11, 2024, which granted financial independence to Nigeria’s 774 local councils.
Among the 24 defendants in the suit are the Attorney-General of the Federation, the Minister of Finance, the Central Bank of Nigeria (CBN), the Minister of Budget and National Planning, the Accountant-General of the Federation, and several state finance commissioners. Also listed are the Revenue Mobilisation, Allocation and Fiscal Commission, the Nigerian National Petroleum Company Limited (NNPCL), multiple commercial banks, and an individual, Bello Lawal.
ALGON’s legal team is seeking judicial intervention to compel the participation of local government representatives in the Federation Account Allocation Committee (FAAC) meetings and to prevent any disbursement of funds to local governments without prior authorization from ALGON itself. The group insists that any distribution of funds through intermediaries or commercial banks is contrary to the Supreme Court’s directive.
Representing ALGON, counsel Okechukwu Uju-Azorji argued that certain government agencies and financial institutions were actively bypassing the ruling by orchestrating the allocation of local government funds without input from the councils.
The Central Bank of Nigeria, however, through its counsel Sam Ologunorisa, SAN, filed a preliminary objection challenging the court’s jurisdiction. The apex bank claimed that ALGON lacks legal recognition under Nigerian law and was neither a party nor a beneficiary in the Supreme Court judgment.
Similarly, counsel for FAAC, Olawale Fapohunda, SAN, echoed the CBN’s position, insisting that ALGON lacks the legal capacity to initiate such proceedings.
Furthermore, state finance commissioners argued that under Section 6(1) of the Allocation of Revenue (Federation Account, etc.) Act of 1982, local government representatives are not listed among statutory FAAC members, disputing ALGON’s claim to a seat at the table.
In its defense, ALGON submitted a counter-affidavit affirming its legal existence as a registered association since May 10, 2002, and reaffirmed its mandate to defend the rights and autonomy of Nigeria’s local governments.
The court is expected to address these jurisdictional issues and the core of ALGON’s claims at the next hearing in late May.
