Federal High Court Orders EFCC to Vacate Lagos School Premises Pending Case Resolution
The Federal High Court in Lagos has ordered the Economic and Financial Crimes Commission (EFCC) to immediately vacate the premises of Goodwill Private Schools Limited in Ikorodu, Lagos, pending the resolution of an ongoing legal dispute.....KINDLY READ THE FULL STORY HERE▶
Justice O.A. Owoeye of Court 10, Federal High Court, Ikoyi, issued the order on Monday, April 7, 2025, after hearing arguments from the school’s counsel, Benson Enikuomehin, who was supported by a team of five other lawyers. The EFCC was represented by legal officer Hannatu Umar Kofarnaisa.
Dr. Enikuomehin argued that the EFCC’s occupation of the school premises violated Section 17 of the Advance Fee Fraud and Other Related Offences Act (2006), which governs the procedure for non-conviction-based forfeiture. He also stated that the interim forfeiture granted to the EFCC through an ex parte application was improper, as it bypassed the necessary legal process.
The defense further highlighted that the disputed property was acquired through a legitimate contractual transaction between Goodwill School and First City Monument Bank (FCMB), and thus did not qualify as proceeds of crime under the provisions of the Act. They also criticized the EFCC’s handover of the property to a private individual, Mrs. Olabisi Olaiya, asserting that only the Federal Government could legally benefit from such forfeiture under non-conviction proceedings.
The EFCC’s legal team argued that the matter had already been settled by the court and that the school’s refusal to vacate constituted a criminal offense. However, the school’s counsel countered that EFCC operatives had occupied the premises since February 27, 2025, halting academic activities, including preparations for the West African Senior School Certificate Examination (WASSCE).
Justice Owoeye ruled in favor of Goodwill Private Schools, ordering the EFCC to vacate the premises and cease further interference until the matter is fully resolved. The court also indicated that a date for the final decision would be communicated.
