Edo Tribunal Upholds Okpebholo’s Victory, Rejects Accord Party’s Petition

The three-member panel, led by Justice Wilfred Kpochi, delivered a unanimous judgment on Wednesday, stating that the petition lacked merit and did not present sufficient grounds to annul the governorship election held on September 21, 2024.
The tribunal also rejected the petitioners’ request for the Independent National Electoral Commission (INEC) to conduct a fresh election, stating that the Accord Party and its candidate failed to meet the legal burden of proof.
According to the tribunal, the petitioners made vague and unsubstantiated allegations of electoral malpractice, including vote rigging, non-compliance with the Electoral Act, and corrupt practices. However, they did not provide credible evidence or specify polling units or wards where the alleged infractions occurred.
The panel ruled that no reasonable cause of action was established and upheld all preliminary objections filed to challenge the petition’s competence.
INEC had declared Governor Okpebholo the winner of the election with 291,667 votes, defeating the People’s Democratic Party (PDP) candidate, Asue Ighodalo, who scored 247,655 votes. The Accord Party candidate, however, garnered just 252 votes.
Despite the significant vote margin, the Accord Party pursued legal action, alleging irregularities such as multiple thumbprinting, voter intimidation, and the failure to deploy the Bimodal Voter Accreditation System (BVAS) at several polling units.
The tribunal’s decision follows a similar ruling where a petition filed by the Action Alliance (AA) seeking to annul Governor Okpebholo’s victory was also dismissed.
With the dismissal of petitions from both the Accord Party and the Action Alliance, the tribunal now prepares to deliver its judgment on the remaining case filed by the PDP and its candidate, Asue Ighodalo, who are contesting the election results and seeking to be declared the winners.
