Legal Challenges Emerge Over Rivers State’s State of Emergency Declaration

Published

on

The recent declaration of a state of emergency in Rivers State has sparked significant controversy, with legal experts, including the Nigerian Bar Association (NBA) and the African Bar Association (AfBA), arguing that President Tinubu lacks constitutional authority to suspend elected officials. The 1999 Constitution, according to these legal bodies, provides clear procedures for the removal of governors, deputy governors, and members of state assemblies, which were not followed in this case.....KINDLY READ THE FULL STORY HERE▶

While the federal government’s decision is partially backed by some observers as a necessary consequence of the emergency, it raises concerns about the violation of Nigeria’s federal structure. In 2004, former President Obasanjo invoked emergency powers in Plateau State, suspending both the governor and the state assembly following widespread violence. However, such measures have been historically controversial in a democracy, where political disputes should ideally be resolved through legal and diplomatic means.

The Rivers State crisis primarily stems from a political standoff between Governor Fubara and members of the state assembly loyal to former Governor Wike. This prolonged discord has left the state’s governance in limbo, denying citizens the benefits of a functioning democracy. The imposition of emergency rule, critics argue, undermines the state’s democratic institutions and could lead to severe economic repercussions, particularly in an oil-rich region like Rivers.

For the sake of the state’s stability, President Tinubu should prioritize dialogue and constitutional solutions rather than resorting to autocratic measures. Restoring the balance of power through legal and political avenues, as opposed to emergency rule, is crucial for safeguarding Nigeria’s democracy and federal integrity.

A Strong Endorsement for Donald Duke

  • Surpassing Competitors: Speaking during an interview, Baba-Ahmed confidently stated that, candidate for candidate, Donald Duke outperforms all other presidential contenders currently in the political space.

The Strategic Push for an Opposition Coalition

Despite possessing what he considers the superior candidate, Baba-Ahmed explained why the party is actively championing a broader political alliance:

  • Consensus Over Ego: The PRP chairman emphasized that the party’s push for a mega-coalition is driven by consensus and constitutional processes rather than forcing Duke’s candidacy through on profile strength alone.

  • Defeating Fault Lines: Framing the 2027 election as a critical turning point for the nation, Baba-Ahmed noted that the stakes go far beyond individual party ambitions. The coalition aims to unite likeminded opposition forces to rescue Nigeria from its current trajectory and bridge its deep fault lines.
