Bill To Curb Defections Of Lawmakers Passes Second Reading In House Of Representatives
A bill aimed at curbing the frequent defections of federal lawmakers from one political party to another has passed its second reading in the House of Representatives. This legislation comes in response to the growing trend of lawmakers defecting, particularly from opposition parties to the ruling All Progressives Congress (APC). Over the past few years, numerous defections have occurred in both the Senate and the House of Representatives, raising concerns about the integrity and stability of the political process.
Clause 1 of the bill seeks to amend Section 68(g) of the Constitution, specifying that no member of the Senate or House of Representatives can be considered to have defected to another political party unless they have first submitted a resignation letter to the political party that sponsored their election. The resignation must be communicated through a verifiable medium such as physical delivery with official acknowledgment, electronic mail, or other legally recognized means.
The bill aims to make the process of party defections more transparent and accountable by ensuring that lawmakers formally resign from their original party before joining another.
Constitutional lawyer Femi Falana has weighed in on the issue, labeling the mass defections of lawmakers in the National Assembly as illegal. He emphasized that any lawmaker seeking to defect must first resign from the party that sponsored their election, urging adherence to legal standards in the defection process.
This bill follows a significant ruling by the Federal High Court in Abuja in 2022, which sacked two members of the House of Representatives and 18 members of the Cross River State House of Assembly for defecting from the Peoples Democratic Party (PDP) to the APC without resigning from their original parties. The court ruled that such defections violated constitutional requirements.
