Legal Experts And Human Rights Groups Urged To Expose Torture In Nigeria
Human rights advocate Femi Falana (SAN) has called on the Nigeria Bar Association (NBA) and the National Human Rights Commission (NHRC) to raise awareness and encourage citizens to report instances of torture by security forces. In a statement issued on Sunday, he condemned the practice, noting that it violates both national and international laws as well as the Constitution, which forbids degrading treatment of citizens.
Falana referenced a historic case, Mogaji v. Board of Customs & Excise (1982), where armed agents used excessive force in Lagos markets under the pretext of searching for contraband, which he described as a direct violation of constitutional protections.
He pointed out that the Anti-Torture Act mandates the government to safeguard individuals’ rights, including those of detainees and suspects, ensuring they are free from torture. Falana reminded that the law stipulates a 25-year prison sentence for anyone convicted of torture, with the penalty escalating to murder charges if the victim dies as a result of the abuse.
The Senior Advocate of Nigeria expressed concern over the continued extraction of forced confessions in the absence of legal representation, which often leads to unjust legal procedures. He urged the NHRC, NBA, and human rights groups to spearhead efforts to expose and report such violations across Nigeria.
