Federal High Court Delays Speed Darlington’s Rights Enforcement Suit
The Federal High Court in Abuja has postponed the hearing of a ₦300 million fundamental rights enforcement lawsuit filed by Nigerian singer Darlington Achakpo, popularly known as Speed Darlington, against the Inspector-General of Police, Kayode Egbetokun, to January 27, 2025.....KINDLY READ THE FULL STORY HERE▶
The adjournment followed a request by CSP Audu Garba, representing the IGP, for additional time to review a further affidavit served by Speed Darlington’s lawyer, Abubakar Marshal, during Monday’s court session.
Background
Darlington’s suit challenges his alleged unlawful detention by the Nigerian police, which stems from a December 23, 2024, court directive that required the police to either charge or release him within 48 hours.
In previous rulings, the court ordered Darlington’s release pending the substantive hearing and directed his legal counsel, Abubakar Marshal, to act as surety for him. The case arose following his arrest in Lagos over allegations of defamation and cyberstalking against fellow artist Burna Boy.
Court Proceedings
During Monday’s hearing, Marshal informed the court that the session was meant to address the substantive application for enforcing Darlington’s fundamental rights. He acknowledged receiving a counter-affidavit from the police on Friday, prompting his filing of a further affidavit on the same day.
CSP Garba admitted to receiving the counter-affidavit but argued that he had not reviewed the newly submitted affidavit, necessitating a request for additional time. Despite Marshal serving him a copy in court, Garba maintained his objection.
Justice Musa Liman, considering the objections, rescheduled the hearing to January 27 for the adoption of arguments.
Claims and Allegations
Darlington, 39, seeks ₦300 million in damages for alleged unlawful detention, torture, and inhumane treatment during his arrest. His legal team is also requesting an order for his immediate release or presentation in court.
The police, however, claim the delay in compliance with the earlier release order was due to the holiday season and cite an ongoing criminal case against Darlington, alleging he had jumped bail.
The court will hear arguments and determine the next steps at the upcoming January 27 session.
