SERAP Challenges Nigeria’s New Cybercrime Law For Violating Freedom Of Expression

The legal action challenges the alleged misuse of the Cybercrimes (Amendment) Act 2024, accusing it of being used to suppress freedom of expression and infringe on the rights of activists, journalists, bloggers, and social media users.
In a statement issued on January 12, 2025, SERAP’s Deputy Director, Kolawole Oluwadare, stated that the amended Act contains vague, arbitrary, and repressive provisions, which enable authorities to criminalize legitimate expressions and curtail media freedom.
“The amended Cybercrimes Act paves the way for criminalizing legitimate expression and punishing activists, journalists, bloggers, and social media users. It is a punitive approach that fails to protect against misuse, particularly regarding the peaceful exercise of human rights,” SERAP’s statement read.
Background and Legal Context
The ECOWAS Court ruled on March 25, 2022, that Section 24 of the original 2015 Cybercrimes Act was “arbitrary, vague, and repressive,” ordering Nigeria to repeal the provision to meet its human rights obligations. Though the amended Act removed Section 24, SERAP argues that the new wording still infringes on the rights to freedom of expression and information.
Allegations of Misuse
SERAP highlighted several cases where the law was allegedly abused to target government critics. Activist Dele Farotimi faced charges under the amended law, while journalist Agba Jalingo was charged with cyberstalking for reporting on a law exam scandal involving a former governor’s relative. Other incidents included the arrest of Chioma Okoli for commenting on the sugar content of a tomato mix and the re-arraignment of four bloggers.
International Human Rights Standards
SERAP stressed that the amended law contradicts international human rights standards, which mandate that any restriction on freedom of expression must serve a legitimate purpose and be proportionate.
SERAP’s Demands
SERAP seeks a declaration that Section 24 of the Cybercrimes (Amendment) Act 2024 is unlawful and inconsistent with Nigeria’s human rights obligations, alongside an order for the government to amend or repeal the legislation to comply with international standards. No date has yet been set for the hearing.

The Arrest and Detention: Nasera explained that the miners went to the site to earn a living to feed their families before NSCDC personnel arrested them and held them in custody for three days, allegedly refusing release efforts.
