Transgender Student Protection Policy Faces Major Setback In Federal Court

U.S. District Judge Danny Reeves ruled on Thursday that the Department of Education overstepped its authority by interpreting Title IX to include gender identity.
The decision follows a legal challenge by six Republican-led states, which argued the policy violated states’ rights and imposed unconstitutional mandates. Judge Reeves, appointed by former President George W. Bush, wrote:
“Expanding the meaning of ‘on the basis of sex’ to include ‘gender identity’ fundamentally alters the intent of Title IX.”
The judge also stated that the policy infringed on educators’ First Amendment rights by requiring them to use pronouns consistent with a student’s gender identity, potentially conflicting with their religious beliefs or free speech protections.
This ruling marks the first permanent decision against the Biden administration’s policy, following temporary blocks by other federal courts and the Supreme Court’s earlier refusal to allow parts of the rule to take effect in 10 states during ongoing appeals.
Tennessee Attorney General Jonathan Skrmetti, who spearheaded the challenge, praised the decision, calling it “a significant victory for women and girls across the nation.” He further criticized the policy as an unconstitutional overreach by the Biden administration.
The Biden administration introduced the rule to ensure transgender students could access facilities and programs aligning with their gender identity, arguing it was crucial for protecting civil rights and preventing discrimination.
Opponents, however, raised concerns about privacy and religious freedoms, particularly in sex-segregated spaces like restrooms and dormitories.
The Departments of Education and Justice have not yet responded to the ruling. Legal experts predict an appeal, potentially leading to a Supreme Court case.
The decision’s timing, alongside President-elect Donald Trump’s imminent administration, adds uncertainty to the future of federal protections for transgender students. Trump has previously expressed opposition to such policies.

The Allegation: The survivor, Malam Babawo Tudun Nasera—whose 17-year-old brother Salim was among the deceased—stated in a video that authorities wanted the miners to halt operations, but they continued working based on instructions allegedly given by Babangida.

The Arrest and Detention: Nasera explained that the miners went to the site to earn a living to feed their families before NSCDC personnel arrested them and held them in custody for three days, allegedly refusing release efforts.

Suspicious Circumstances: Raising questions about the sudden deaths, Nasera noted that the detainees had eaten well the day before, speculating that heat exposure or some form of administered substance may have been involved.
