Court Reverses Kano High Court’s Decision, Calls For Fair Trial In Sanusi’s Case

Delivering the lead judgment, Justice Mohammed Mustapha stated that the Kano High Court had acted unfairly by failing to notify Muhammadu Sanusi of the hearing, which deprived him of the opportunity to defend himself.

Justice Mustapha described the lack of notice as a violation of the principle of natural justice, asserting that no party should be condemned without being heard.

The Appeal Court criticized the handling of the case, labeling the proceedings as poorly arranged. It also emphasized that all parties must have equal chances to present their cases in court.

The case has been remitted to the Chief Judge of the Kano State High Court for reassignment to a different judge for a swift and fair hearing. Justice Mustapha, however, decided against imposing any costs on the respondents.

Speaking to journalists in Abuja on Tuesday, Kachikwu argued that the convention violated a Federal High Court order issued on April 14, which directed all parties to maintain the status quo pending the determination of a case filed by ADC state chairmen against former Senate President David Mark and others.
