Edo Election Petition: Tribunal Confirms 290 Witnesses In Ighodalo Vs Okpebholo Case
The Edo State Governorship Election Petition Tribunal in Benin City has announced that 290 witnesses are expected to testify in the case challenging Governor Monday Okpebholo’s victory in the September 21, 2024 election. Tribunal Chairman Justice Wilfred Ikpochi made this known during the presentation of pre-hearing reports and the scheduling of hearings. He explained that the proposed witnesses had been outlined in a harmonized pre-hearing proposal, but did not specify how many witnesses each party would call. The petitioners have 21 days to present their witnesses, while the respondents have 10 days.
Ikpochi emphasized that only witnesses who had submitted sworn statements or were subpoenaed would be called, and expert witnesses could also testify. He highlighted the tribunal’s commitment to adhering strictly to the Electoral Act 2022, warning against unnecessary adjournment requests and limiting written addresses to 40 pages, formatted in double spacing with a 14-point font.
The tribunal has also granted interrogatories directed at INEC and Governor Okpebholo. The case has been adjourned to January 13, 2025, for hearings, with the tribunal sitting daily except on Sundays and public holidays.

The Allegation: The survivor, Malam Babawo Tudun Nasera—whose 17-year-old brother Salim was among the deceased—stated in a video that authorities wanted the miners to halt operations, but they continued working based on instructions allegedly given by Babangida.

The Arrest and Detention: Nasera explained that the miners went to the site to earn a living to feed their families before NSCDC personnel arrested them and held them in custody for three days, allegedly refusing release efforts.
