Human Rights Activist Farotimi Challenges Defamation Charges, Demands Case Dismissal
Dele Farotimi, the Lagos-based lawyer and human rights activist, has filed a preliminary objection seeking the dismissal of the defamation lawsuit against him at the Ado Ekiti Magistrate Court.....KINDLY READ THE FULL STORY HERE▶
Farotimi’s legal team, led by Senior Advocate of Nigeria Adeyinka Olumide-Fusika, submitted the request on Monday, ahead of the scheduled hearing on Tuesday.
As previously reported by DAILY POST, Farotimi was granted bail in the amount of N50 million on Monday.
In the preliminary objection filed on December 9, 2024, Farotimi raised several legal points under various sections of Nigerian and Ekiti State laws. The application is grounded in Section 36(8) of the 1999 Constitution of Nigeria, Sections 4(1) of Ekiti State’s criminal law, and relevant sections of the Ekiti State Administration of Criminal Justice Law (2014).
Farotimi’s legal team outlined five primary grounds for the objection, arguing that the charge brought against him was not supported by law and was void. The specific grounds include:
- The 16-count charge relates to offenses under the Criminal Code Act, which is not applicable in Ekiti State.
- The Criminal Code Law, previously adopted in Ekiti State, has been repealed and replaced by the Criminal Law of Ekiti State, 2021.
- The alleged defamation of Aare Afe Babalola, SAN, OFR, his associates, and the law firm Afe Babalola & Co., as detailed in the charge, is not recognized under the Criminal Law of Ekiti State, 2021.
- As such, the charges are non-existent in the current law of Ekiti State.
- The Magistrate acted without jurisdiction in entertaining the charge and ordering Farotimi’s detention, as the charge was based on an invalid law.

West African Tax Institutes Under Nigerian Leadership for the Next Two Years
Nigeria has officially assumed leadership of the West African Union of Tax Institutes (WAUTI) for the next two years, following the election of Mr. Samuel Agbeluyi, President of the Chartered Institute of Taxation of Nigeria (CITN), as the President of the Union. WAUTI, which comprises National Tax Institutes/Associations from ECOWAS member states, is committed to enhancing tax professionalism, improving tax compliance, and streamlining tax administration within the region. With Nigeria at the helm, WAUTI aims to further its vision of harmonizing tax practices across West Africa, fostering a transparent and equitable taxation system that boosts economic growth and compliance.
In his acceptance speech, Agbeluyi expressed his gratitude for the opportunity to lead the organization, vowing to collaborate closely with fellow executives and stakeholders to advance the Union’s objectives. He highlighted his commitment to working on regional partnerships that will support professionalism in the tax systems of WAUTI’s member states.
Agbeluyi’s vast experience, which includes serving as the Honorary Treasurer and 2nd Vice President of CITN, has positioned him well for this new role. He is also a distinguished member of various prestigious bodies, such as the National Institute for Policy and Strategic Studies (NIPSS), and has earned numerous accolades in the field of taxation.
In addition to Agbeluyi’s election, other members of WAUTI’s Executive for the 2025-2027 tenure were also selected, including the re-election of Mr. Innocent Ohagwa, CITN’s current Vice President, as the Honorary Treasurer. This marks the beginning of a new era of regional cooperation in tax administration under Nigerian leadership.
