The suit, dated October 4, 2024, claims Mr. Ewere is the rightful owner of the vehicle and seeks to establish his entitlement to it.

According to the lawsuit, the vehicle was initially cleared by Customs officers in Lagos after paying all required fees, including customs duties amounting to N700,440. However, during a later encounter, Customs officials demanded an additional payment of N2.5 million. When Mr. Ewere attempted to resolve the issue, the officials allegedly confiscated the vehicle and transported it to Benin City, without issuing any seizure notice. Efforts to trace the vehicle through various Customs offices across Nigeria proved unsuccessful until the car resurfaced in July 2024, having undergone significant changes, including being repainted from white to black.

The vehicle was eventually intercepted by the police, leading to the arrest of an individual, Mr. Phillip Charles Utienyinrestsola, who failed to provide proof of ownership. He claimed to have purchased the vehicle from a dealer who, in turn, said it was acquired from a Customs auction. Currently, the car is held in Delta State police custody.

Attempts to get comments from the Nigerian Customs Service were unsuccessful, as the spokesperson did not respond to calls or messages. However, a representative of the NCS Public Relations Unit indicated that the matter is now for the court to address.
