The lawsuit, numbered FHC/WR/CS/19/2022, alleges that the funds were redirected without informing Nigerian regulatory bodies or the impacted victims.

The spill, one of the region’s worst environmental disasters, occurred during crude oil loading by the vessel MT Nothia, leading to widespread pollution. Despite the insurance policy with Certificate Number 0492900 covering $1 billion for pollution indemnity, affected communities were reportedly excluded from the compensation process.

OSPIVV’s lawsuit, filed in April 2022 against Shell and Britannia Steamship Insurance Association Limited, aims to recover the funds and hold the corporations accountable. The case seeks to bring justice for the communities whose livelihoods and environment have suffered for over a decade due to the spill. Jalla also highlighted that key agencies such as NOSDRA and NIMASA were kept in the dark regarding the insurance claim, complicating efforts to resolve the issue.
