Senator Tony Nwoye (LP, Anambra North) initiated the debate, raising concerns that some state governments were attempting to undermine the Supreme Court ruling by passing contradictory laws in their state assemblies. Nwoye cited efforts by certain governors to reintroduce the controversial State/Local Government Joint Account, which had been declared unconstitutional by the court.
Nwoye’s motion, co-sponsored by nine other senators, called for the strict enforcement of the Supreme Court ruling, ensuring that local councils retain full financial autonomy. The motion was seconded by Senator Osita Izunaso (APC, Imo West).
However, Senator Adamu Aliero (PDP, Kebbi Central) raised a constitutional point of order, urging the Senate to avoid further debate. He emphasized that under Section 287 of the 1999 Constitution, Supreme Court rulings must be enforced nationwide, making any further discussions redundant.
“Supreme Court judgements are binding across the country. There’s no need for debate here,” Aliero said.
Senate President Godswill Akpabio agreed, but added that amendments to the Constitution, particularly Section 162 (6), which created the State/Local Government Joint Account, might be necessary for full implementation of the court’s ruling.
Before a conclusion could be reached, Senator Nwoye invoked another standing rule for a personal explanation, while Senator Abdulrahman Summaila Kawu (NNPP, Kano South) raised a similar point of order, creating confusion in the Senate. The ensuing disorder led to an emergency closed-door session at 12:46 PM.
