The PDP’s appeal, filed on July 9, contests the judgment delivered by Justice Inyang Ekwo on July 4, 2024. Justice Ekwo had declared the February 22 primary election invalid, citing the exclusion of 378 elected ward delegates from participating in the primaries.

Justice Ekwo’s ruling emphasized that the PDP’s failure to adhere to its constitution and electoral guidelines constituted a breach, specifically violating Article 50(3) of the party’s constitution. The judge stated that adherence to these regulations is crucial and likened the failure to disregard the Electoral Act 2022.

In response to the ruling, the PDP, through their lawyer Adeyemi Ajibade (SAN), argues that the lower court’s decision is flawed. The party contends that the court’s judgment was not supported by sufficient evidence and misinterpreted the case. The PDP asserts that the February 4 ad-hoc ward congress, which produced the delegates, was conducted properly and that the delegates who participated in the primaries were duly elected.

A family source told Vanguard that the General was speaking with his identical twin brother, who resides in the United Kingdom, at the time of the attack.

According to the source, the twins maintained a daily routine of speaking around midnight, but the conversation took a sudden turn that night when unusual activity was noticed at the General’s end.

The twin brother reportedly made repeated attempts to reconnect, sending messages and calling continuously, but received no response throughout the night.

“He kept trying until about 4 am, but there was no answer,” the source said.

The family later confirmed the tragedy after a senior military officer contacted them around 6:30 am, informing them that the base had come under attack and that the Brigade Commander was among those killed.
