Edo Guber: Court Upholds Kadiri As Labour Party Deputy Governorship Candidate

On Thursday, the Federal High Court in Abuja confirmed Prince Yusuf Kadari, SAN, as the deputy governorship candidate of the Labour Party (LP) for the upcoming gubernatorial election in Edo State.....KINDLY READ THE FULL STORY HERE▶

In his judgment, Justice Emeka Nwite ruled that the Labour Party acted within its rights by nominating Kadiri as the running mate to its gubernatorial candidate, Olumide Akpata.

Justice Nwite stated that the electoral body had no authority to reject Kadiri’s nomination, as the party’s actions complied with the provisions of the Electoral Act 2022 and the amended 1999 Constitution.

It is noteworthy that Akpata had selected Kadari as his running mate for the election scheduled for September 21. However, despite the party forwarding Kadiri’s name to INEC, the electoral commission published Alufohai Oluyinka Faith as the LP deputy governorship candidate.

Recognizing the error, the Labour Party requested INEC to correct the published name to reflect the nominated candidate. When INEC failed to comply, the Labour Party took the matter to court.

In the case marked FHC/ABJ/CS/556/2024, with INEC as the sole defendant, Justice Nwite criticized the commission for refusing the substitution request. He highlighted that Section 31 of the Electoral Act 2022 allows a political party to request the withdrawal of a published candidate within 90 days of a scheduled election.

The judge concluded that the Labour Party’s actions were in accordance with sections 29, 31, 32, and 33 of the Electoral Act 2022.
