Edo Guber: Court Dismisses Suit Against PDP Candidate Asue Ighodalo

Justice Obiora Egwuatu of the Federal High Court in Abuja has dismissed a suit aimed at preventing Barrister Asue Ighodalo from being presented as the Peoples Democratic Party (PDP) candidate for the upcoming Edo State governorship election.....KINDLY READ THE FULL STORY HERE▶

The lawsuit, filed by aggrieved PDP governorship aspirant Anselm Ojeizu, was deemed premature as it was initiated on March 6, before exhausting the party’s internal dispute resolution mechanisms.

In his ruling on Wednesday, Justice Egwuatu stated that Ojeizu had failed to utilize the mandatory internal processes of the PDP to address his grievances before approaching the court. He concurred with Ighodalo’s lead counsel, Akinlolu Kehinde, SAN, that bypassing the PDP’s Appeal Panel constituted a breach of the party’s rules.

Ojeizu had sought an order to cancel the February 22 primary election that declared Ighodalo as the PDP’s gubernatorial candidate, citing violations of the Electoral Act 2022 and PDP guidelines. He alleged that a fake delegates list was used during the primary election at Samuel Ogbemudia Stadium in Benin City.

However, Justice Egwuatu emphasized that all aggrieved aspirants must comply with internal dispute resolution procedures before taking legal action. He referenced Supreme Court decisions underscoring the necessity of adhering to such procedural requirements.

Ighodalo, a lawyer and investment banker, emerged as the PDP’s governorship candidate on February 22, securing 577 votes. He defeated several other aspirants, who each received zero votes, with six votes voided out of the 585 accredited delegates. The Chief Returning Officer of the Edo PDP Gubernatorial Primaries and Zamfara State Governor, Alhaji Dauda Lawal, declared Ighodalo the winner.

Ighodalo is believed to be the preferred candidate of Governor Obaseki.
