Lawyers To Sue Tinubu, NASS Over Reintroduction Of Old National Anthem

In a statement released on Friday by Dr. Tonye Clinton Jaja, ALDRAP’s Secretary, the organization contends that the enactment of the law did not follow the constitutional provisions required for such legislative changes. The key points of their challenge include:

  1. Lack of Public Hearing: ALDRAP argues that no public hearing was conducted before the legislation was enacted, which is a requirement under Section 60 of the 1999 Nigerian Constitution. Public participation was crucial when the previous national anthem was adopted in 1978, but it was absent in this instance.
  2. Lack of Public Input: The public was not invited to contribute to the legislative process, a necessary step to ensure transparency and inclusiveness in the enactment of significant national laws.
  3. Procedural Irregularities: The group states that there was no official transmission of the bill from the President to the President of the Senate and the Speaker of the House of Representatives, as mandated by law.
  4. Budgetary Concerns: ALDRAP claims that the expenditures related to the enactment of the National Anthem Act, 2024, were not included in the Federal Budget, rendering the law financially unsustainable and illegal.
  5. Economic Impact: The group highlights the significant financial burden that the new law would impose on citizens. This includes costs associated with updating official documents, educational materials, and the time required for citizens to learn the new anthem.

ALDRAP references the legal precedent set by the case of Attorney-General of Bendel State vs. Attorney-General of the Federation (1981), which stipulates that any law failing to comply with constitutional legislative procedures is null and void.

The lawsuit, to be filed at the Federal High Court, lists the Incorporated Trustees of ALDRAP as the plaintiff, and the President of Nigeria, the President of the Senate, the Speaker of the House of Representatives, the Clerk to the National Assembly, the National Wages and Salaries Commission, the Revenue and Fiscal Allocation Commission, and the Accountant-General of the Federation as respondents.

This legal challenge follows President Tinubu’s signing of the National Anthem Act, 2024, on May 29th, which has sparked significant controversy. Critics argue that changing the national anthem amid pressing economic and security challenges is misplaced. Former Minister of Education, Obiageli Ezekwesili, among others, has publicly stated her refusal to sing the reinstated anthem. Despite the backlash, President Tinubu defended the decision as a priority during a meeting with the Arewa Consultative Forum.

The controversy continues to unfold as Nigerians and legal experts debate the necessity and legality of the reintroduction of the old national anthem.
